Last time (in 2008) TSC was very fast in approving the cases, NSC was bit slow, thought it would be a good statistic at a glance on approvals.
What is the purpose of knowing which center processed?

Hello Everyone,

Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

Hi all,


I am a consultant working on H1B and my 3rd yr of visa expires in march 2011.
Im planning to file my GC through my current employer in EB2 category(As I have a masters degree) but have following queries :

1.My company is a small company with only 2 employees i.e. me and my manager.
If i do file my GC through such a company,whats are the pros and cons e.g. any RFE expected because its a small company considering that have already had an RFE when transferring my H1B to this company earlier.


2.Can I file my GC through a different employer say my end client or any other company while im working with my current employer?

3.Considering the above situations,what is the best option for me to file my GC at tis point of time?

Also filing my GC in EB2 category will help avid processing delays as per the current trend?

Please advise.

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

Our new company policy: No more employment based green cards for another 3 years :D

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.

As I understand , either there would be no bulletin revision(currently appearing impossible) or there would be a bulletin revision making some categories unavailable , in which case it doesnt matter even if your application has made it on July 2nd it will be returned. So why is the rush to get applications by mail/fedex/samedaydelivery/inpersondelivery/etc ?
Or is the rush to deliver only for those applicants with PDs in 2002-2004 who are hoping that their PD will make it in the new bulletin if it is not unavailable? I see no reason for the rush which seems to have increased after the rumor about the new bulletin on friday ...(although I personally asked my lawyer to send it on friday 6/29 and for which I have no confirmation if it was actually sent or not).

I need your suggestions on my situation and below is the same.

1. Priority date (04Oct2006) is current in June bulletin
2. Applied labor & I40 with previous employer.
3. Applied I485 in July 2007 ( applied I 485 before marriage) with previous employer
4. Joined other employer on Sep 2009
5. Not applied AC21 portability to new employer.

Now my priority date is going to be current as of June 1st, so need to file I-485 for my wife. Based on my situation could you please suggest the best approach to apply dependent's I485. i.e Apply dependent I485 from previous employer or through my new employer asking for AC21 along with employment verification letter).

Appreciate your help in advance.

I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.

I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet

AILA InfoNet at Doc. No. 01040603

I couldnt locate this memo in USCIS policy guidance memoranda search.

Can some one with access to AILA Infonet, please send me this document

I am happy to write that today I received my first emailed receipt notice for a FY 2010 H-1B application and that then, about 5 hours later, I received an emailed approval notice in the same case. The I-129 was a U.S. Masters Cap case that was premiumed processed with the Vermont Service Center.

I will update this site as I receive word on my other FY 2010 H-1B cap cases.

Completed my 6 years on H1B and returned back to India on personal reasons.

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

2. How sure about getting approval of H1B.
