    One of my friends has goofed up his labor filing:

    His actual date of termination with his previous company was 5/31/2007, but in the labor filing he has said that he was employed with the previous company till 6/30/2007....
    he is ready for filing his 140(EB2)? can he correct his dates of when he files for 140....

    WILL HE HAVE TO file for labor again??????????:(

    Dude / Dudette.. I dont work for MSFT but the general thing is .. wait for 180 calender days post your I485 and make a move using AC21. You don't have any provisions to move with AC21 anyways. Take it easy.

    You can re-apply via the new employer without stamping. I have done that myself.

    I filed in EB2 catagory through company A ( small size company )based on future employment
    PD- Sep/04.
    I-140- Pending.

    I am currently working with company B ( Multinational ). My current status is 5th yr H1B ending in Oct 07..Current employer ( Company B ) has finally approved to file PERM labor..

    I am struggling to decide if I should file I-485 with company A awail the current dates and at the same time continue to file PERM in next couple of months with company B..

    Would it creat any legel wrangling later on?

    I am already in my 5 th yr of h1B with company B and there is no guaranteed job opportunity with company A..

    Appreciate if any one in the forum could help resolve my situation.

    thats means its not approved. u cant file for i140 without labor approval..hence cannot file 485 also.

    Hello,
    I have attended Toronto consulate on Apr 18th for my 7th yr h1b stamping. I have i140 approval. The consul gave me 221g yellow form and later received 2 emails asking for some documents which I submitted. I still have not heard any response and I understand it could take months before I get any answer. My question is can I leave Canada and go to India while the process is in review and come back to Canada if and when my H1b stamping is approved. I have multiple entry visa to Canada so I could potentially come back. My question is can I leave Canada while my visa is under process and would it have any affect?

    Yes it is pretty much recognised for h1b purpose or for any other purpose whatsoever. I got my first h1b approval on the basis of my MBA from IGNOU.

    Thanks - I took this walking along a railroad bed that is no longer in use. I must have chased 10 of these things around before I finally got this one that would hold still long enough to get a descent shot.

    I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
    Here is my current status :
    6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :

    1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
    2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
    3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

    it may be possibal, but thats really pushing the limit of flash. I whoudnt reccomend trying it, but thats kinda up to you. You shouldnt even think about it unless your an expert at actionscripts..

    I apologize for posting the totally un-related information for our IV cause but I think atleast some of us will be interested in another social cause happening back in India for the past year or so.

    We all are affected by a number of social issues in our daily life and together we can be more stronger in dealing with them.

    I felt sad for these kids (who started this campaign, most of them have returned back from US, for the only selfless purpose of changing the society) when I heard that they were attacked by hooligans. Let us provide them with some moral support, at the least.

    No one from EB3 category posting their success story of geting a GC recently. What does that mean, VB PD is just foolling us and making you to go crazy.

    :confused: I couldn't log on for 5 minutes and then when I finally did - most of the latest posts have dissapeared?

    when lots of people try to log in at teh same time you can get a DOS .. please refresh and try again.
