All I want to know is even today EB1 2008 gets his GC before 2001 EB3 and that is fair to everybody. But the minute EB2 got preference things have become unfair how is that?
There were simply two barriers put by CIS for EB GC one is EB Category (horizontal bar) and Country of birth (vertical bar) Now country of birth is something not in your hands where as EB category is something that you can change (acheive) its in your hands. Come one all of us if we study hard can qualify for EB1 but because of various reasons or circumstances we chose to be in EB2 or EB3 (people who crib about employers or any other reason know in their hearts that i they wanted to change they could have simply they decided to remain happy in what they got)
So instead of asking to mountain to come to mohammed people should take this news positively and see how they can benefit from it. The spill going to Eb3 ROW was not helping any one since there is no way one can change country of birth
Starving any particular queue badly does not help the throughput of any system .
I hope DOS will realise this and change their algorithm accordingly.
Each countries quota is equally divided among all EB categories, IMO, The spill overs also should be equally divided among all the EB categories.

Is fragomen filing EAD & AP on time?
I have been following up with them to file my EAD renewal since 10 days and today I received a response that they are busy with audit and will do as soon as they can, I don't want my ead application to be delayed, its already more than a week I was eligible to file EAD renewal.
anyone else having problem filing EAD & AP in time with fragomen, pls share.

IV core needs to develop a thick skin, and not be affected by barking dogs like these.
I'm all for IV!! This is the only organization fighting on behalf of those stuck in GC retrogression. There are some anti-immigrants who come to this website, sign up under Indian identities, and try their darnest best to bog down the efforts....

You can certainly twist that interpretation. That is unrelated though.
Remember that pro amnesty folks and Democrats are in sync with Karl Rove on immigration. Immigration was more like a neutral ground on this given the magnituted of other issues.

"Payback's a bitch.
There is no way to spin the election results. They were a repudiation of George W. Bush, his party, his agenda, and his war. The commander in chief argues that he is fighting a war in Iraq that is essential to the survival of the United States. The electorate sent a message: we don't buy it. "
It is obvious that the war and the recent scandals are the solely reason on why Republicans lost seats in the House. See polls conducted all over the place showing that. I just read an exit poll at CNN in which the war and scandals were the solely driving force on this.
Put yourselves on the American's shoes; how would you vote if you have your own son dying in Iraq. With all the due respect, Pres. Bush persistence on "staying the course" is frightening. What would you do in this situation ? That's the most serious thing one can imagine. Then you see "conservatives" involved in cases of corruption and gay sex, you ask yourself, what the heck. The GOP really messed up big time. Americans are not stupid. They voted the GOP out as a way to show that those not doing a good job would be kicked out.
To the advantage of those wanting amnesty, that may go in their favor. Just remember that you may get your GC, but then that may also mean that America as we know it may be coming to an end. Wait until those 20+ million petition for their relatives and install here their way of life.

When President Bush delivered his CIR speech, Lou Dobbs criticized CIR as amnesty and he went on suggesting "No bill is better than a bad bill" to Congressman Sensenbrenner et. al.
Sensenbrenner took this advice verbatim and finally rejected CIR instead of conferencing on modifying it.
I think Congress got the blame later and was termed "Do-Nothing Congress" mainly for this.
It is a bitter lesson for politicians not listening to Senate or President but to Lou.
IMHO, if Congressman Sensenbrenner took CIR to conference (instead of a month-long public hearings) to remove controversial provisions and pass legitimate provisions like the border fence measures, public would have retained the current congress.

Air France still does not get it. neither do other euro nations, Nor does Australia.
They are now dealing with a entirely different generation of Asians who do not care if they were once a developed nation or that they can manufacture aircrafts.
The reply is still suggestive of they taking care of the passengers and handling the situation well. No, they did not.
A technical aircraft problem is something that every airline faces everyday.
Air France not having a plan to care of non-american or non-eurpoean indians is completely their fault and outright racist. and that too a flight which is flying to India?
Did they expect everyone on the flight to be from a EU or North American nation, and that they will not require transit visas.
No, they simply did not care. They just did not make arrangement for Indian residents and hid behind the transit visa excuse.
If they wanted, they could have arranged for a Airport Transit visa for eveyone who did not have one.
But no, they assumed that regardless of how we treat them, an indian is going to fly Air France again if that is the cheapest option.
Funny is, that might be true, but that demographics is changing so fast that they better keep not caring, cos Indians will not fly with them anyways.

I am not a lawyer, but this is what my understanding: if your I-485 was is pending for at least 180 days and your I-140 was approved at the time when you used AC21, you should be safe. In this scenario, even if the ex-employer revokes your I-140, you should be fine and if USCIS has denied your I-485 based on this, you should be able to fight it.
USCIS usually won't deny a I-485 unless the applicant was out of status at some point of time. Sometimes, the attorney messes up the application somewhere and that causes denial. But again, as someone has mentioned, USCIS is suppose to issue NOID before denying it. If they haven't done so, this gives you an additional material to fight the denial.
I would suggest that you wait for the denial notice and see what it says. If it sounds complicated or you think the USCIS has made a mistake, get a reputable attorney and file a MTR.

Seems like this is just a Republican backed bill. Dems will fight this or insist that some provisions for illegals be included as well. Also once elections are over it is possible that the Dems will be majority and then this bill gets kicked to the side.
is it not sad to see voting trends decide stuff like this.
I do hope to one day vote in this country (I voted in every election in my home country after I became eligible).
If the dems do "kill the SKIL", they would have definitely lost my vote in the future. I know it is inconsequential compared to the millions they will gain from the illegals becoming legal. but in my small way, that will be my protest.

Hi,
I am from Jordan and I attended the rally. 4 of my friends "who are Jordanian and have their citizenships already" drove from Chicago to attend the rally, but they got lost in Baltimore. They wish all of us all the luck and they support all of us 100%:)
That have been said and as I mentioned on another threat, I know 10 people from India who work with me and promised to meet me there, but no one of them attended, and I called them before the rally at their offices and all of them were there. I am very disappointed of them.
Thanks for attending rally...yes, you will see lot of Indians taking back seat..just forget them and lets move forward.

Everbody's posts here are speculations on what USCIS will do ...
Geez.....you definitely need a brain check.
:D :D :D
Say at USCIS's "mid month" meeting, they are discussing the major points:
<conference call service> badoop! badoop! badoop! badoop!
Dr. Emilio T. Gonzalez, Director: OK, it is 11:30, everyone ready for our morning bi-monthly call?
Jonathan Scharfen, Deputy Director: I'm Here Dr. Emilio!

Lynden Melmed, Chief Counsel: Mr. Melmed, Esq., Present!

Dr. Emilio T. Gonzalez, Director: OK, who is late! Who is it! Speak up!
Jonathan Scharfen, Deputy Director: I think it was Jeffrey! I got a virus last week and he..
Dr. Emilio T. Gonzalez, Director: Enough Jonathan!
Jeffrey Conklin, Chief Information Officer: I'm here. I was just instructing our IT staff how to reboot the talky thingy phone system.
Jonathan Scharfen, Deputy Director: You mean the "V.O.I.P. Call Center."
Jeffrey Conklin, Chief Information Officer: I know I was going to...
Dr. Emilio T. Gonzalez, Director: Enough Jonathan! I'm not inviting you next meeting if you continue this. Lets get started! Now Lynden. You there? What is that status of this class action suit? My girlfriend said I was wearing a "class action suit"!!

Dr. Emilio T. Gonzalez, Director: Shut up Rendell!! Lynden! You make those foreigners and their case GO AWAY! That is our job, to make them GO AWAY! Don't you know that that is what we do here? How long have you been here Jones? Not much longer at this rate!!! Rendell! Were do we stand with this. It is July and the board has not finished our bi-annual bonus calculations yet. Dr. Emilio T. Gonzalez, Director: hmmmmph.
Jeffrey Conklin, Chief Information Officer: In fact we're really busy with that call center. Phones are ringing off the hook!
Dr. Emilio T. Gonzalez, Director: As long as they don't get my number!

Just being paranoid, but is 797 the number for the "receipt notice" as well as notice of action? I know that when H1 or 140 is decided, the notice of action form is called 797. I know that the USCIS seems pretty clear in the FAQ, but just wanted to confirm that a receipt is also called 797

My last and final update to this post. I got my original Green Card (Cards not green color) It was the happiest day, the wait was finally over the air smelled a little better.
My two cents - Have patience explore other means of getting green card if one doesn't work. An attorney once told me there are soo many ways and regulationsto get green card that half of them are not even in law manuals only the old timers know about them. Enjoy life life with green card and with out it is the same.but the time you spend never comes back. If you have problems with your employer just imagine if you didn't have a job. So make the best of your time and enjoy this great land which we call america.
Thanks
Congrats!!!!!!!!!!!!! man

Akhil, Chandu thanks for the support. It's heartening to see it coming from other state chapter leaders for our efforts.
Offline work is on to compile data gathered before, during and after the meet. Some of the Meeting action points (easier) will be implemented soon. The rest will also see a forward movement.
Work is on to determine how to include members who couldn't participate personally, yet conveyed support and/or willingness to participate in our future activities - during the call, and/or through E-mails. We want to include everyone interested in our future activities. We also appreciate any other form of real tangible support coming from non-attendees agreeing to our cause and chapter activities. This will be crucial as we get into future activities, SOON!
