    OP was never out of status as he was working for one of the employers on proper work authorization all the time. The only question is whether employer X canceled H1 ?Even if they didn't, it is employer's problem not OP's.

    Anyways it is better to respond to this query through a lawyer.

    I was all the time in valid status. I was legal with 'employer #1' H1B and before it expires, I got H1B from 'employer #2', before 'employer #2' H1b expires, I got EAD (used with Employer #2 and still with 'employer #2').

    At some point while with my current employer (employer #2), I thought of changing job and 'employer x' sponsored my H1b (I do not know if it is new H1 or transferred), but changed mind, and continued work with 'employer #2'. 'Employer #2' did not cancel my H1B at any time. I have called 'Employer X' and he said my H1B was canceled last week.

    If that's the case, why DOS made it unavailable? It could have maintained same June 2007 bulletin for rest of the year right? - Never understand, how their brain works? :confused:

    Because going back to 2007 bulletin is lot of work for them. Looking at PD of each application and seperating it from the lot. If they just made it U, its easy...send everything back.

    I was sick rest of the day.

    I hesitate every day in doing things that help them. So far I have taken temporary decisions to continue.

    It is mentally very draining!

    I totally understand what you are going through, been there myself! Don't mind those people, keep going and do this for YOURSELF! Yes, many people will benefit from our struggle without having moved a finger, that is sad but that always happens, in every struggle, in every issue. There are other very sad things such as the visa lottery, or the 1985 amnesty which saw thousands of people from overseas come to abuse that even if they didn't qualify, and all those people got a free ride! But you know what? They are there and they won't go away. It is our choice to stay and not go away, and we have to fight for that. Together, we are friends and family at IV. That was evident at the rally! Times may get trying at times, but we'll keep going and succeed!

    He is stuck in Atlanta for PERM...PD around April-07...though I feel sorry for Atlanta guys. This guy deserves a ban. Good riddance.

    Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..

    She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

    I dont know what all these exchanges with CS Reps is doing for others......but it is making me laugh like crazy....bet they dont have a clue about why our ass is on fire since Monday July2nd (early fireworks from USCIS for our benefit ...huh?)

    Trust me you are in the better hands. Everyone is suffering no one happy with their attroney.

    Once i called USCIS for my AP using BUNNYBOY sequence. The USCIS officer was rude and asked me who is the attroney. When i mentioned fdbl then he mentioned that fdbl is a respected within fdbl.

    They take the process long but their success rate is 99.99%

    Hello mmandal,

    Many of us who visit IV forums everyday know that snethil1 is an idiot. I would highly recommend more people to add him to your ignore list, just as I did. I read his post because you quoted him in your post. Otherwise his posts do not even show up on my screen. He and his posts are inconsequential if you add him to your ignore list.

    Companies were vague on numbers. So how could they satisfy Senators. I knew only a few companies gave detail about open positions including Microsoft, Intel and oracle. How you can impress Senate or house? But anti immigrants gave all the layoff numbers, h1b numbers used and details of abuses happened for past few years. It is not just money power will win. With facts and numbers if you have money power then you can win. That is reason for past 3 years H1b numbers or GC numbers were not increased inspite of heavy lobbying.

    I guess there is very little follow-up on this issue.



    That doesn't mean nothing is being done. I am continuing to do a lot of work on this, but there is nothing new to post right now.

    To date I have been able to get every newspaper in the country to do stories on this, as well as three scathing editorials in the NY Times, LA Times, and Mercury News, all of which slammed the government for its action.

    I have worked with the staff of a member of Congress to ensure that house representatives were aware of the issue.

    As a result, the house of representatives unanimously passed the HEART Act giving stimulus payments to affected soldiers overseas.

    I have been able to get an important legal organization to review and research the topic for possible litigation.

    I would love to go over the legal details with you, but it is not prudent to give too much detail here right now.

    And finally, I have been corresponding with immigrants like you providing advice and updates on the situation.

    I am not sure what more you expect.

    Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?

    I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.

    So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.

    Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.


    I highly doubt the HR dept of an organization is filing labor certs, I-140s and I-485s without the assistance of immigration attorneys whether in-house or outside counsel. I work for one of the largest hospital chains n the US, and our HR offices use external counsel for immigration matters.

    I have a H1B visa and was in US for 2 months. Now im back in India.
    I got H1B visa from a no 1 company in India. Can i go to US again for another company using the same H1B visa. Can i do a H1B visa transfer from India.
    If i do a transfer, will the company which sponsered the H1B visa create any problem.

    Hi Gurus,
    Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.

    Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I can’t go for VISA stamping in India for Company B as I have not got my H1 Approval yet.

    Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?

    What all documents I have to carry to reenter safely?

    I'm not sure if its ok to travel when an application is pending, check with some experts... but if I were you I would Convert it to PP and get the approval before travel and get stamping done... Thats the best option.

    I recently sent a letter to the USCIS Director Explaining the problems faced by H4's because the stay in H4 counts towards the H1 time. Just to bring up the matter of Decoupling H1 time and H4 time. May be it was long forgotten in the bureaucracy.

    I couldn't find an email address of the USCIS Director, Not even a full Address.
    I used the address below. It might reach there or come back to me.

    If it reaches there and if I receive a response I will post it.

    I read, somebody had contacted ombudsman in this issue, but I feel he is powerless. and can only make suggestions.

    Let us hope the decoupling memo will be out... Or better the H4 get allowed to work as the L1s.

    The L1 work permit law was passed in 2001 March. Does anyone has any idea which group lobbied for it?

    You should be fine dont worry, just do it in time. I got my MTR approved in 7 weeks successfully on providing the required docs from new company.

    If you have changed job after 180 days.
    Just provide additional evidence about your new position and new company details. Make sure your new position matches your labor certification and I 140 requirements.

    Your MTR should be approved after 7 weeks.

    I think it would be a good idea to make the move. There isn't enough data available for me to say anything more than it's going to be quite a while before your priority date becomes current.
