    Politics makes strange bedfellows and while anti-immigrants band together they donot have any additional support from other groups (I maybe wrong and IEEE and Programmers guild may be joining them). On the other hand we do have support from industry even though they primarily support H1B increase. Suffice it to say that we play a very important part because we are the grassroots part of the whole industry lobbying machine where the industry lobbyist can show that the affected parties are in support of what they are saying.

    Finally, I got the PIO card. It did not take long after sending a $20.00 MO, I got the PIO card in about a months time. The total time it took me was about 2 and 1/2 months...although they claim the processing time would be at the max. 45 business days.

    The PIO card looks pathetic. Its hand written and the passport like book looks too cheap. Crap looking PIO card.

    I saw the new PIO processing fee, includes the return postage, which is a good thing. No more calls to anybody asking to send again the postage fee...seems to me the Govt. of India, plugged this little hole.

    Getting rid of semilar\same job requirement is going to be as easy or as difficult as getting prefiling AOS.

    Getting rid of same\semilar job is not semilar to getting to green card. If you are a software person then you can put a restriction that you have to work in a software related job, in the same way if you a civil engineer then you should work in the civil engineering field. But the way USCIS does same\semilar job is job code match, responsibilities match etc etc etc, the problem with this is it is a very grey area, it is almost like doing labor all over again. It has not become that bad yet but it will sooner or later, how many H1b rfe\denials did you know in the last 2 years, I bet there are more H1 denials in the last 2 months than the whole of last 4 years.

    I understand you are not being selfish but why would anybody want to use EAD instead of H1 other than for getting rid of visa stamping purposes. The overwhelming majority of people are going to use EAD to switch jobs because of layoff . When people are transfering H1b because of layoffs they are getting rfe\denial notices, when you move from H1b to EAD because of layoff USCIS might hit you with the same\semilar job rfe (when you file ac21, when previous employer revokes H1 or I140), that is my point.






    What I am saying is bring in protection to AOS by
    -removing the same or semilar job requirement in AC21
    Its not that easy to make this adjustment. If you take out this clause a person can work any where and this is more like a green card. For example a software person can even work in a gas station. I am afraid, this cannot be done as easy as you think.--- Again, I am not saying that it should not be done; all I am saying is let us keep this as a separate item

    the keyword is "certain", in skil that "certain" meany MS or PHD, what does this certain mean, it all depends on the definition of certain, it would be nice if the use the same definition of skil (masters and phd)

    One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.
    I heard that if you are non resident of USA, the tax rate is 30% ( for Indian residents). Also I heard that you can collect SS if you have paid 10 years SS tax even if you don't have GC/ citizenship at the age of 60. But we don't know whether the SS will be there by that time when we turns 60!.:rolleyes: Don't know whether we will be there!. :eek:
    The Dollar value may go upside down by that time:cool:

    Hello guys,
    I had a strange issue with my wife previous H1-B.
    she came to US on H4 on 05.03.
    some x comapany processed her H1 and got approved on 10/1/2004
    and valid till 9/30/2007.
    on 1/2/2006 she change from x Company to y comapny and still working for y company.

    For applying for GC, i checked her online status for x comapny (old) in uscis site..found strange thing...her old employer did not receive any notice from INS...Please advise...

    How can one know if ones employer has withdrawn/cancelled ones H1B visa? Apart from asking the employer, if one uses the EAC # ans checks the status on www.uscis.gov, will it be reflected over there?

    Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!

    Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, so there is no question that you recent h1 is valid and past is invalid. Get an attorney, Good weekend

    While I clearly do NOT agree with the original basis of this thread, here are the facts as I see it:

    - We have an immigration backlog that affects a huge community and several people are only waking up to how serious this issue is (I will count myself in this category)
    - IV has made significant contributions towards espousing our cause through the proper channels (via the press and lobbying)
    - There is therefore greater interest today in an organization like IV and a desire to be part of the process including potentially financial contributions
    - Hoewever, a lot of the new folks are looking for direction and a sense of belonging and action
    - IV's policy of limited information dissemination (due to arguably valid reasons including the desire not to reveal any strategies to opponents of immigration) is not engendering the confidence required to welcome new members.
    - An appeal for blind faith instead is just off-putting to most logical and thinking members and threads like these are nothing but an appeal for more information (stated rather poorly, I am afraid).
    - In order to succeed, we clearly need to get everyone united


    The reality is - IV needs a lot lot lot funds,IV needs manpower, IV needs your skills, IV needs your unity, IV does not need your criticism because if you criticize IV it won't help you.
    So you and I together - united we stand - we build IV - if we do not want to take that extra step - we all suffer...............


    Chandu, I chose to quote you since everything you are saying makes a lot of sense ( I also appreciate all of your posts and all the work you have done for so many years). In fact, with Obama's administration at least ready to talk about immigration, I think we have the perfect opportunity to get our point of view across through lobbying, which as you have said, will take a lot of funds. However, that said, is it really hard for the current team to undertstand that there are a lot of folks out there who want to contribute but would at least like to be informed on what is going on?     I completely understand that those who are working hard on our cause don't really have the time to update others, especially given everything else in life they have to deal with. However, when there are people ready to take on this task, why the hesitation and the defensiveness in sharing information? We really need to move involve more people in this effort to have any chance of succeeding. I know a lot of folks have said something to the effect "it's not our job to inspire people - if they cannot be inspired to contribute, let them go to hell". However, I do think it's the job of leadership to inspire and get more people behind them or else no one will succeed - I really wish the Core team moves in this direction.

    Disclaimer: I am a recent "Donor" and have certainly not put in anywhere near the amount of effort or money that several of the committed members like you have

    I am not with rv reddy firm, but i heard good things about the extend he went to file 485s by July 2nd.. 2 of my colleauges goes through him. I was very impressed by the proactive emails he sent out during the july fiasco, updating his client on how cases will be handled.
