Bestin, I looked at your signature, and felt very proud for you. You applied your labor in July 2007 only, and you are fired up to support and contribute to the cause. I wished i were here before (IV) but ofcourse its human life isnt.We learn from experience.If at all IV was here before or if there were active forums like this earlier i am not sure if i would have ever thought of coming to US.Now after coming here and learning lessons its almost like we are stuck- not only on immigration but also to maintain our commitments.There were phases wherein i was literally upset on my decision to come to US which i beleive most of us would have gone thru at one stage.
America always vouches freedom for all,but they missed the point that there is literally no freedom for those who come to US by ethical means.See the plight of USCIS.Its like a monopoly.U can hardly question.A simple example is my wifes L2 EAD.Once she got the FP notice and receipt i sent all relevant documents by USPS delivery confirmation .At the 90th day they issue an RFE asking for the same documents.If it were in India it would have been used for packing samosas.But who knows what happens in USCIS.Now we need to wait again.Can we question them on what happened to the documents i sent?Its unnecessary waste of time.I beleive its high time USCIS thinks on outsourcing to be more effective..
I am not saying Indian Govt offices are better.
Just consider howmuch we spent on GC filing?I personally had to spend for filing and attorney and medical approx 7000$ (ya i had to use my company attorney as my labour was approved in last time).If atleast 200000 people did spend atleast 5000 ,then see how much we spent .Atleast 1000,000,000 dollars inside America during June to August 07 out of which atleast 50% to USCIS for something which MAY OR MAYNOT happen after years.And again a confirmed money 1500-2500 dollars every year for attorney+uscis fee for EAD and AP.The figure which i mentioned is just for an example,the actual figure might be twice.
In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute.And yes we pay for SSN,medicare for americans to enjoy at florida after 60.
Inspite of all these,some people here think we are just to steal their jobs and send money to India.If people dont realise they are competent,then their way is to oppose immigration reforms.
I have seen lots of Americans here complaining on stress and taking stress releivers and yoga.I am sure their life expectancy would be reduced to 1/2 of what they have if they were to undergo immigration inside America now especially from retrogessed countries.Serious its not a joke.:D

Dear All,
All the infigting and ranting we do, only creates a lot of negative energy and negative vibrations. People will continue to do what is right for them and normally try to be in the right side of the law. There is no point discussing about this.
Let us all be clear that within the next year, despite the spillover, both EB2 and EB3 will get absolutley clogged - I expect EB2 and EB3 nos to become more or less equal and clogged. This situation is not going to benefit anyone.
The only possible thing is to try sincerely for some legislative relief, unitedly. Everyone knows that it is like moving a mountain. I spoke to many friends about IV efforts and tried my best sincerely to raise money for advocacy. It was a futile exercise. I felt so sad to realize that everyone I spoke to, was cynical and said that nothing would work out in our favour. Under such circumstances, it is essential that the very few who are committed to work stay united and sincerely try! For most of us with grown up children, this is the only way! Like it or not!
Why cannot all of us atleast make a small contribution for the advocacy? What is the problem?
Again, as a person who is seriously stuck in this mess with children on the verge of completing high school, I have very little options left. Most of the good colleges are NOT willing to consider "aliens" like us eligible for instate (local) tuition. Did anyone think of this? All of us will have to pay international fees! Who can pay $ 50000 per annum? Under the circumstances, please note that many of us will have to return to India or atleast move our families! I wrote a letter to my Senator about this and I got a response saying that he cannot do anything about it. Please think about all the consequences before wasting time on endless EB2 - EB3 fights!
I also want to repeat what I had said a few months back. No immigration system that is not time bound is fair or transparent. With all the sincerity at my command (I have nothing to gain in the process) I would request youngsters in their early and mid 30s to seriously consider options in other "First World" countries which have time bound immigration programmes for highly qualified immigrants. It is an endless wait here.Do you want to spend the next 10+ staring at the visa bulletin very month? . I do not want my junior countrymen to commit the mistake of sinking in this quagmire. With due respect to all the hard work of gurus like Teddy and others, I still feel that it would take about 12 - 15 years for anyone of us waiting beyond Jan 2007 (though I do not wish for it). What would be the state of the economy then? Any thoughts?
High time we stay focused and use this forum in a positive way!

I applied for my spouse's PIO card (to the Houston consulate) in January, we recd it in about a month.
Here is a list of what I sent:
1. Two copies (with photographs) of the completed PIO application
2. Three additional 35 mm x 35 mm photographs (not sure if this is reqd or not, some of the other consulate websites mentioned xtra photos, so we just sent them)
3. Money order for US $385 in favor of �Consulate General of India, Houston� (includes $20 towards express mail charge for return of PIO card)
4. Notarized copy of relevant pages of spouse's foreign passport
5. Notarized copy of spouse's birth certificate
6. Notarized copy of relevant pages of spouse's father�s Indian passport (proof of father�s Indian citizenship and permanent residence in India)
7. Copy of relevant pages of spouse's mother�s Indian passport as proof of mother�s Indian citizenship and permanent residence in India
8. Copy of relevant pages of spouse's family�s ration card showing residential address.
9. Copy of my electric bill showing current US address
10. Letter of employment showing proof of long term residence/ job in US.
11. Copy of H1 approval notice and visa copy.
We probably sent more than the minimum required, so you will have to draw your own conclusions on what to send and what to omit.

Hey guys
Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.
I think they misplaced AC-21 application and also they missed NOID step. This is basically two mishaps. Looks like every thing is messed up.
Motion-to-reopen is right step as after denial, beacse case is deemed to be closed after AOS denial.
I am not sure, how much info-pass can help.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.
the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!
so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

Mark, point taken but I do believe if we can raise some stink then we should. The Law firms need to realise that the country club memebership is coming at the cost of some poor sap stuck in the immigration rut and all he/ she needs is kind words and sound advice. I shall stop my ranting about Fragomen after this post.
On your other point about law firms participating. What makes you think they already do not have a member in the forums. If they read this good then the messeage has been sent across.
If approached in the right way there is a chance that big law firms will be helpful to us. The way to do this is politely, not raising a stink, with a credible number of their clients supporting us. The big law firms could act as a "force multiplier" to use a military term, only a small fraction of the community currently know about us, the big law firms and USCIS are the common connection for EB GC process, and USCIS is not about to email all their customers about us. With the right encouragement law firms might just help.

I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.
If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.
If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.

This time mostly bill will be passed in the senate. But no one knows how house will handle. If house also passes some form of CIR then Conference commitee will have power for synchronisation of house and Senate. That time some important provisions could be thrown out. Who will be in conference comittee?

At a high level; country quotas in EB do not make a whole lot of sense. I have tried to figure out why they are there; how companies and candidates use EB greencards. Conclusion, I came up with is that in a lot of ways EB is a way to circumvent family base immigration. Many peoples parents have greencards, brothers, sisters, friends, etc; and they realize that it takes too long to get greencard through family base and the fastest way is to come through h-1b and go through EB route. Also; companies; company owners will favor their own people in filing h-1b's and greencards and then you have a situation where certain people are favored due to their nationality or connection. I firmly believe that uscis and the regulatory authorities understand this and hence the reason why there is country quotas.

So far there have been around 100k approvals in EB3 category out of about 170k (unused family visas made available to emploment based category) approvals in employment based category. Out of that EB2 approvals are around 50k only. Now the scenario would be like 100k approvals in EB2 and out of that 50k would be exclusively for EB2 India, leaving very little share to china. Now you could presume how fast EB2 runs.

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.

I dont mean to discourage folks here...
But here is what I have seen more often with MBA. Techies like programmers, business analysts in IT sector have done their MBAs from good schools and ended up doing the same job EVEN WITH GREENCARDS.
I have seen GC holders doing MBA and then after finishing MBA ending up with same job description with a 5% increase in pay.
So please do your research in HOW MBA is going to help you in your situation. Your job and your INTENDED JOB POST MBA may not really need you to have an MBA. And I have seen this way too often. So think before you pluck down 30,000 dollars on a degree that might do little benefit financially after you complete it.
From what I know, MBA is more of a long term goal, not an immidiate short term thing. If you plan on continuing your career as a techie, then MBA might not be the right thing for you. But, if you plan on moving up the corporate ladder, then having an MBA helps in a big way. A lot of financial companies and IT companies prefer their corporate executives to have an MBA (preferably from a well reputed school). When you have 2 candidate with similar attributes, but one of them has an MBA, then for a corporate position, the choice is obvious.
There are always exceptions to this. If you are exceptionally good, then having this degree may not be necessary at all (the reverse holds too :) )
Finally, the biggest advantage of going to a top B school is the social networking aspect. The kinda people you meet at a top school are the ones that have a high potential for opening companies, working in a substantial role in good companies, etc. It is always good to be networked with such folks. If you are the entrepreneurial type, then all the better!

This is so confusing. But I-129 does have a section to identifying new vs. continuing employer. Isn't moving to a new employer automatically means that new paycheck MUST come from new employer regardless of whether existing employer has canceled the H1B or not. If you don't intend to work for new employer they MUST cancel the H1-B or you should request them to cancel it ? Otherwise it will bound to generate the confusion that's apparent from the I/O looking at your petition.
I am thinking it can be interpreted either way, but nothing in the laws says one way or the other. It is all up to I/O's interpretation.

1. Employer-X Files new H1
2. Employer-2 Withdraws existing H1
3. You changed your mind
4. Employer X Withdraws H1

Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......

Thanks for writing. Supposing everything goes smoothly, what is on average the time frame to get to the stage where you get a PD. I'm not looking for miracles to get GC through nobel prize or gold medal. Just trying to have an idea here. Take it easy on a the poor man bro :)

Even those who are just eligible to file for the last stage, its likely to take years longer on average.
Other than suggesting you win a Nobel prize, win an Olympic gold medal, or select the country of your birth, there is little feasible that I can say.
The good news is, things could move a lot faster than those of us that are or were stuck in the Backlog Elimination Centers.
Oh - and those talking about the reintroduction of CIR - remember, it also was taking out pretty much all AC21 provisions which will still affect people on EAD

If that is so the capital preserved by not doing an MBA in a top ten school which I estimate to be about 60-70K if I am not mistaken might be put to another use.

A lot of hard data shows that that is anything but the truth. That kind of money can be spent in buying a house for instance or something that is much more worthwhile. Nowadays, there are jokes about MBAs not being able to open a pdf document.
But I must add that after you've spent 10-15 years in industry, and you want to climb the corporate ladder, an MBA from Harvard or Sloan (or the very few top schools) will definitely help. The returns fall drastically as the rank of the school falls. Surprisingly, the fees don't fall that drastically, and that's why one has to be careful.
As far as ranks, created by US News etc, go: here is the thing. Arizona State is ranked in the top 50. But does it have the same reputation as MIT? No. So even if the ranking is in the top few, make sure the reputation is truly high. And that means three or four schools: Harvard, Wharton, Sloan ...

I don't know why you are wasting your time calling uscis. The fact is that USCIS released a statement they would reject all applications. Please don't waste your valuable time and focus of media and your senators. Please don't count on miracles. For now uscis may hold the applications for a few days because of the congressional action by congresswoman Lofgran, but we should keep the momentum and increase the awareness of this important issue.
Contact you senators and the press like others did! Thank You.
