    HI,

    I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

    Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

    Hi,

    Thank you very much for free service.
    My brother is working for company X.
    They have recently got one labor cert approval. The ads are 3 months old which they used for one employee who is working in exactly his skillset and responsibility.
    He is planning to ask the company to do one GC for him in same category.

    1. Can they use the same ads for him also.
    2. If they can use, then what amount of time will it save for him.
    3. What are the different things one has to do, before filing labor like wage determination, with specific employee, and how much time each thing take. Are these tied to any specific employee, or can they be used for others also.
    4. Somebody told me if valid ads are there, then it can save him 2-3 months, is it true.

    Hello All,

    I just wanted to ask for your general advice. My H1B expires in July 2010 so I know I have to turn in my PERM application before then so I really have only about 2 months to start recruitment process. I also have a green card to Canada so I could go there but I do like my current job in the US and living in New York City is really great!

    Anyway, my question is. How tough do you think it will be to start PERM process now in this current economic downturn and the fact that it is in New York (millions of people)? Do you also think there might be some legislation in a near future to make it more difficult for us to get green cards?

    I understand you can't answer those questions exactly, but a piece of advice would be greatly appreciated. Thank you all!

    Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

    I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.

    i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
    we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.

    my Q is can we get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
    should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
    can we get visitor visa before leaving USA? i mean converting from H1 to B1 for multi year?

    i would appreciate some suggestions.
