    We have become political hypochondriacs. We seem eager to declare that "the system" has come down with some dread disease, to proclaim that an ideological "center" blessed by the heavens no longer exists, and woe unto us. An imperfect immigration bill is pulled from the Senate floor, and you'd think the Capitol dome had caved in.

    It's all nonsense, but it is not harmless nonsense. The tendency to blame the system is a convenient way of leaving no one accountable. Those who offer this argument can sound sage without having to grapple with the specifics of any piece of legislation. There is the unspoken assumption that wisdom always lies in the political middle, no matter how unsavory the recipe served up by a given group of self-proclaimed centrists might be.

    And when Republicans and Democrats are battling each other with particular ferocity, there is always a call for the appearance of an above-the-battle savior who will seize the presidency as an independent. This messiah, it is said, will transcend such "petty" concerns as philosophy or ideology.

    Finally, those who attack the system don't actually want to change it much. For example, there's a very good case for abolishing the U.S. Senate. It often distorts the popular will since senators representing 18 percent of the population can cast a majority of the Senate's votes. And as Sen. John McCain said over the weekend, "The Senate works in a way that relatively small numbers can block legislation."

    But many of the system-blamers in fact love Senate rules that, in principle, push senators toward the middle in seeking solutions. So they actually like the system more than they let on.

    As it happens, I wish the immigration bill's supporters had gotten it through -- not because I think this is great legislation but because some bill has to get out of the Senate so real discussions on a final proposal can begin.

    Notice how tepid that paragraph is. The truth is that most supporters of this bill find a lot of things in it they don't like. The guest-worker program, in particular, strikes me as terribly flawed. The bill's opponents, on the other hand, absolutely hate it because they see it as an effective amnesty for 12 million illegal immigrants. And, boy, did those opponents mobilize. In well-functioning democracies, mobilized minorities often defeat unenthusiastic majorities.

    And some "centrist" compromises are more coherent and politically salable than others. Neither side on the immigration issue has the popular support to get exactly what it wants. So a bill aimed at creating a path to citizenship for illegal immigrants is full of grudging concessions to the anti-immigration side. These have the effect of demobilizing the very groups that support the underlying principles of this bill. That's not a system problem. It just happens that immigration is a hard issue that arouses real passion.

    Typically, advocates of the system-breakdown theory move quickly from immigration to the failure of President Bush's Social Security proposals. Why, they ask, can't the system "fix" entitlements?

    The simple truth is that a majority of Americans (I'm one of them) came to oppose Bush's privatization ideas. That reflected both a principled stand and a practical judgment. From our perspective, a proposal to cut benefits and create private accounts was radical, not centrist.

    An authentically "centrist" solution to this problem would involve some modest benefit cuts and some modest tax increases. It will happen someday. But for now, conservatives don't want to support any tax increases. I think the conservatives are wrong, and they'd argue that they're principled. What we have here is a political disagreement, not a system problem. We have these things called elections to settle political disagreements.

    Is Washington a mess? In many ways it is. The simplest explanation has to do with some bad choices made by President Bush. He started a misguided war that is now sapping his influence; he has treated Democrats as if they were infected with tuberculosis and Republicans in Congress as if they were his valets. No wonder he's having trouble pushing through a bill whose main opponents are his own ideological allies.

    Maybe you would place blame elsewhere. But please identify some real people or real political forces and not just some faceless entity that you call the system. Please be specific, bearing in mind that when hypochondriacs misdiagnose vague ailments they don't have, they often miss the real ones.

    Hello. I am playing around with making a little app that allows me to draw a polygon shape and then determine how many rectangles can fit inside that shape. The rectangles only have two widths, but can be as long as needed.

    It occurred to me that I might somehow be able to have that polygon shape act like a wrap panel and the rectangles inside would self-adjust based on the space provided. Two questions:

    1) Is it possible to make a wrap panel with custom borders (not just rectangular)?
    2) Is there an equivalent component, to the wrap panel, in Flash? If so, can that component have custom borders?

    i have it on Nikon mount, and one of the samples i tested had a back focus issue. i just bought the one that didnt. Sigma is real good at fixing/replacing defective lenses

    I have to agree with that, I did send it back to Sigma and 3 weeks later it was fixed and now I seem to have focussing issues with my A700 and a couple lenses that seem to work fine on my A300 but this Sigma works really well on the A700 and A300.

    I guess no complications unless USCIS asks for employment verification at the time of approving the case. He should continue to file for Income tax retrun for 2010 and also need to work for few months in 2011 to file for return.

    1) I am in USA on H1B.
    2) I have accepted an offer to join companyA in January '07. They have filed for the H1B transfer a few days back. And I have resigned from my current employer.
    3) Now another companyB has agreed to acquire companyA, and they will close the deal in December '06. CompanyB will be issuing revised offer letters to new hires like myself soon.
    So even when my H1B has been filed by CompanyA, it will cease to exist on my joining date (January '07).

    My question is how is the H1B handled in such a case ?
    Can an amendment be sent to the original application saying its for CompanyB, and not CompanyA. Or does CompanyB have to apply for a fresh H1B ?

    General qn : When can I change the employer -- when the H1 papers reach INS or when the lawyers get the receipt notice from INS ?

    They are setting up conference calls with the lawyers soon; I was wondering if I could get some inputs from the experts on the forum as well.

    I have received an email from USCIS that

    Current Status: Approval notice sent
    "On XXXXXX, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service."

    This is the case regarding the application for my brother\sister. However, it's more than 10 days and I have not received the letter yet.

    Called customer service and they said to wait 30 days.

    Also, the processing time showing is March, 1999. I am bit confused what shall I do now. any suggestion or help would be appreciated.

    i'm planning to bring my in-laws to USA and they have their visitor visa appointment next week. everything is set but i'm a littled worried about demonstrating financial stability to sponsor them.
    i have paystubs & employment letter but the bank letter doesn't look so good. i live on check-to-check and my current balance is around 3K. you think i should take chance and go for the interview and hope VO doesn't ask for bank letter or doesn't mind the balance?

    I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .

    Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

    Normally, entering into the US follows the last entry rule. Thus, whatever status a person last enters on is their status.

    There are special regulations when it comes to H-1b status and travelling on AP. I would speak with an attorney prior to travelling.

    Having a pending EB1 I-140 does not in itself confer any status. If you filed an I-485 concurrently, then you are permitted to remain in the US pending adjudication. If you have a currently valid H-1B you may remain or renew pending adjudication.

    More skilled immigrants are giving up their American dreams to pursue careers back home, raising concerns that the U.S. may lose its competitive edge in science, technology and other fields.



    "What was a trickle has become a flood," says Duke University's Vivek Wadhwa, who studies reverse immigration.

    Wadhwa projects that in the next five years, 100,000 immigrants will go back to India and 100,000 to China, countries that have had rapid economic growth.

    WASHINGTON -- Democrats took control of Congress last January promising a "new direction." A year later, the image that haunts them most is one symbolizing no direction at all: gridlock.

    Unfinished work is piling up -- legislation to aid borrowers affected by the housing mess, rescue millions of middle-class families from a big tax increase and put stricter gas-mileage limits on the auto industry. Two months into the new fiscal year, Democrats are still scrambling just to keep the government open.

    President Bush and Republicans are contributing to the impasse, but there's another factor: Intraparty squabbling between House Democrats and Senate Democrats is sometimes almost as fierce as the partisan battling.

    A fracas between Democrats this week over a proposed $522 billion spending package is the latest example. The spending would keep the government running through the current fiscal year, which ends Sept. 30, 2008, but it has opened party divisions over funding the Iraq war and lawmakers' home-state projects.

    After enjoying an early rise, Congress's approval ratings have fallen since the spring amid the rancor. In the latest Wall Street Journal/NBC poll, just 19% of respondents said they approved of the job Congress is doing, while 68% disapproved.

    Democrats are hoping to get a boost by enacting the tougher auto- mileage standards before Christmas, but other matters, such as a farm bill to continue government price supports, are likely to wait for the new year.

    Republicans suffered from the same House-Senate tensions in their 12 years of rule in Congress. But the situation is more acute now for Democrats, who must cope with both Mr. Bush's vetoes and the narrowest of margins in the Senate, leaving them vulnerable to Republican filibusters.

    Democrats in the House interpret the 2006 elections as a mandate for change. They are more antiwar and more willing to shed old ways -- such as "earmarks" for legislators' pet projects -- to confront the White House. Senate Democrats, by comparison, remain more tied to tradition and institutional rules that demand consensus before taking action.

    "The Senate and House are out of phase with one another," says Rep. Barney Frank, chairman of the House Financial Services Committee. "There was a big change last year, a big change that affected the whole House and one-third of the Senate. That's the fundamental disconnect."

    Rather than move to the center after 2006, President Bush has moved right to shore up his conservative base. He has also adopted a confrontational veto strategy calculated to disrupt the new Congress and reduce its effectiveness in challenging him on Iraq.

    Just yesterday, the president issued his second veto of Democrat- backed legislation to expand government-provided health insurance for the children of working-class families. In his first six years as president, Mr. Bush issued only one veto. Since Democrats took over Congress, he has issued six vetoes, and threats of more hang over the budget talks now.

    For Democrats, teamwork is vital to challenging the president, and it's not always forthcoming. A comment by Charles Rangel, a New York Democrat who is chairman of the House Ways and Means Committee, suggests the distant relationship between the two houses. "We have a constitutional responsibility to send legislation over there," said Rep. Rangel. "Quite frankly I don't give a damn what they feel."

    Adds Wisconsin Rep. David Obey, the chairman of the House Appropriations Committee: "I can tell you when bills will move and you can tell me when the Senate will sell us out."

    With 2008 an election year overseen by a lame-duck president, it's unlikely that Congress will be able to break out of its slump.

    Sometimes the disputes resemble play-acting. Senate Majority Leader Harry Reid (D., Nev.) has quietly invited House Speaker Nancy Pelosi (D., Cal.) to blame the Senate if it suits her purpose to explain the slow pace of legislation, according to a person close to Sen. Reid.

    At the same time, he can use her as his foil to fend off Republican demands in the Senate: "I can't control Speaker Pelosi," he said last week in debate on an energy bill. "She is a strong independent woman. She runs the House with an iron hand."

    Still, the interchamber differences have real consequences, as seen in the fight over the budget.

    Senate Appropriations Committee Chairman Robert Byrd of West Virginia long argued against creating a big package that would combine all the main spending bills. He preferred to confront Mr. Bush with a series of targeted individual bills where he could gain some Republican support and maintain leverage over the president. But Mr. Byrd was undercut by his leadership's failure to allow more time for debate on the Senate floor. After Labor Day, the House began pressing for a single large package.

    The $522 billion proposed bill ultimately emerged from weeks of talks that included moderate Republicans. The bill cut $10.6 billion from earlier spending proposals, moving closer to Mr. Bush, while giving him new money he wanted for the State Department as well as a border-security initiative.

    No new money was provided specifically for Iraq but the bill gives the Pentagon an additional $31 billion for the war in Afghanistan and body armor for troops in the field. The goal was to provide enough money for Army accounts so its funding would be adequate into April, when a fuller debate could be held on the U.S.'s plans in Iraq.

    For Senate Democrats and Mr. Byrd, the effort was a gamble that a moderate center could be found to stand up to Mr. Bush. The more combative Mr. Obey, the House appropriations chairman, was never persuaded this could happen.

    After the White House announced its opposition over the weekend, Mr. Obey said Monday that the budget proposal was dead unless changes were made. The effect was to divide Democrats again, instead of putting up a united front against the White House's resistance.

    Mr. Obey suggested that lawmakers should be willing to strip out home-state projects, acceding to Mr. Bush's tight line on spending, if that's what it took to make a tough stand on Iraq.

    "I am perfectly willing to lose every dollar on the domestic side of the ledger in order to avoid giving them money for the war without conditions," Mr. Obey said. His suggestion met strong resistance from Senate Democrats. At a party luncheon, senators were almost comic in their anger, said one colleague who was present, loudly complaining of being reduced to being "puppets" or "slaves."

    On the Senate floor yesterday, Texas Republican Sen. John Cornyn said Democrats were showing signs of "attention deficit disorder." Senate Minority Leader Mitch McConnell, a Kentucky Republican, accused the new majority of being more interested in "finger pointing" and "headlines" than legislation. "It won't get bills signed into law," he said.

    While Ms. Pelosi had personally supported Mr. Obey's approach, she instructed the House committee to preserve the projects as it began a second round of spending reductions yesterday, cutting an additional $6.9 billion from the $522 billion package.

    The Senate committee's Democratic staff joined in the discussions by evening, but the White House denied reports that a deal had been reached at a spending ceiling above the president's initial request.

    If agreement is not reached by the end of next week, lawmakers may have to resort again to a yearlong funding resolution that effectively freezes most agencies at their current levels. This would be a repeat of the collapse of the budget process last year under Republican rule -- not the "new direction" Democrats had hoped for.

    Tied in Knots

    The House and Senate are struggling to complete several matters before they head home this month.

    Appropriations: Only the Pentagon budget is in place for the new fiscal year that began Oct. 1. The House and Senate are struggling to finish a bill covering the rest of the government.

    Farm bill: The Senate still hopes to complete its version of a farm bill but negotiations with the House will wait until next year.

    AMT relief: The House and Senate have passed legislation limiting the alternative minimum tax's hit on millions of middle-class taxpayers. But they differ about whether to offset the lost revenue.

    Medicare: Doctors are set to see a cut in Medicare payments in 2008, which lawmakers want to prevent. The House acted, but Senate hasn't yet.

    Housing: Several bills addressing the housing crisis have passed the House but are languishing in the Senate.

    I had the sample problem. There was an extra letter in the last name. I waited till the labor was approved and then notified USCIS while filing I-140. There was no issue. You do not have to worry about it

    Hello,
    I have a new job offer from one of the largest product based company's Global Consulting Professional services.
    Situation:
    1. I am in a PORTABLE AC21 situation over 180 days of 485 filing and an approved I-140.
    2. I have requested the company to prefer my EAD over their H1B offering.

    Questions:
    1. If I take their H1B offer, what are the risks of USCIS asking me a client letter before joining? Please note it is a huge org. The company intends to take me in after obtaining LIN# from premium H1B processing.
    2. The prevailing wage on my LC when filed in 2005 was $60,757 and the offered wage at that time from my company was $76545. My NEW offer in 2010 stands at $118000. Is that an issue?
    3. If I use my EAD which is expiring September2010 and due renewal can I keep continuing work until obtaining new EAD?

    Hello ,

    I just wanted to understand how consular processing works for EB greencard

    1. When NVC sends a I-864 form. is priority date to be current for this ?

    2. When NVC sends a packet 3. is priority date to be current for this ?

    3. what will be happen if the priority date is current and interview was scheduled in next month, and then priorty date suddenly will not be available in next month.

    4. Can I track status with NVC using I-140 receipt number ?

    No. You can't port PD from spouse.
    You can port your own PD, if you have another EB3 approved.
    You can port the country of chargeability, if she was born in another (ROW) country.

    My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

    I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?

    Also does anyone know a good lawyer I can consult over the phone?

    When you have no GC and are on h1 legally...can you go on a cruise..I do not have stamping on the PP ..the cruise goes to some places in the caribean??..is there a immigration check while comming back??..how does this stuff work...OR is it no GC no Cruise??..

    Priority date of old EB3 case: Jan 2003 (140 approved). Started new EB2 case (PD Feb 2007) without notifying uscis of old priority date. Now EB2 140/485 pending since three months. Can I get early EB2-140/485 approvals if I notify uscis of my old priority date now? I belong to "other charge-ability areas" group.

    Hi,

    We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved? In case my I-140 is denied, will she lose her status and would have to leave the country?

    IV Team,

    I'd filed my concurrent EB2 I140+I485 on Aug 17, 2007 at the Texas Service Center. I have been trying to check the status of my I140 petition online for the last 3-4 months. Every time i try to do so, i get the following error message:

    "Case Status Retrieval Failed. This Receipt Number cannot be found at this time in this automated system"

    Am I the only one with this problem ? or are there others experiencing the same issue ?

    Hello everyone,

    I have been following this forum for quite sometime now. I have an issue and need some advice on that. My husband is on EAD and i am H1. I was with company A for a almost 2 yrs and then I joined company B for a project. They applied for my h1 that came through pretty fast through premium process. the project that I was supposed to start on kind of got scrapped and no dates yet known when that would happen. Now my question is that can i go back to company A as they have a project for me and want me to join them again, if i do that compant B will cancel my H1.Please advice if there are any legal issues that might pertain on this kind of case.

    I went for Fingerprinting for I-485 case seond time on 9th May. When it is updated in your profile at uscis website. I see it is still showing up old dates as LUD.
    Any idea ?

    Hi Guys:

    I'm in a process of transfering my H1B to a new employer. I've already hired a lawyer and paid him his fee. The lawyer spoke to my employer and everything was going fine. Now, my new employer tells me that his company "froze hiring" untill further notice !?!

    I'm wondering
    1. Is my employer lying and why?
    2. Can I somehow make my employer pay me back the money I already paid to the lawyer?
