I work for company A. I am on a project actively with an end client from last one year. My company A stopped paying me from past 5 months in spite of them getting paid from the vendor. I have requested my company to release all my payments pending from last 5 months repeatedly. But they don't seem to bother. I am planning to change my employer now.
My question is Am i out of status since I am not getting paid from last 5 months? I have luckily all the copies of pay stubs till a month ago. Only thing is that I haven;t received them yet. Please let me know

Can anyone tell me if a PERM is first audited, and then reaudited, which one will be used for the priority date? the first one or the second one? or it does not matter (based on the date when the PERM was first filed)?

All,
Over the past few days we have been successful in getting good media attention BUT except for NYT, the coverage has not focused on the issues that are relevant and will draw the attention of the policymakers. I think the media drive should focus on getting the following issues highlighted:
1. Lapse in protocol when issuing green cards
a) Green cards issued WITHOUT security clearence
b) Green cards issued to those whose PD was NOT current in June
2. Obvious intent to NOT accept applications in July so that they can receive the same with a higher fee in the future. This at the cost of making a mockery of hundreds of thousand of hopeful legal immigrants
I think the media drive should focus and highlight the above and other key issues rather than merely reporting on the sequence of events. Please share your thoughts and add to the list above

my friend�s six years is going to complete in next month , he has applied labour certification via PARM 10 months back and its pending, did he is eligible to file 140? Or he has to live next month?

Now a days VFS is not releasing appointment dates more than 2 - 2.5 weeks in advance. I am not aware of any specific time of the day when these become available.

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. For those of you who either are residents (Citizens or PRs) or Canada or have been thinking about becoming residents of Canada but working in US, please share your experience in terms of:
1. How you maintain your residency (or non-residency) in both countries.
2. What are the tax implications if you maintain residency in both countries,
specially if you own property in Canada.
I have heard stories about tax implications in Canada if you own property there even if you permanently live an work in the US. Is that true? Would you be considered a resident in Canada for tax purposes just because you own property (such as vacation homes) but live permanently in US.
I currently own a property in Canada but have been living and working in US for past 8 years and really worried about any tax implications in Canada because of the property. Any help would be very much appreciated.

I think you can employ any one on 1090 on temporary basis(nanny or home improvement, reapir etc) , not employ by start a company. Ask a lawyer.

I am a F1 PhD student The company we've been cooperating with gave me an internship offer for this summer working as an independent contractor under CPT for three months.
The univeristy international offer and the career office are both OK with this but I saw some opposite opinion online. Could someone give me a clear answer: is this legal F1 student under CPT working as independent contractor?

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.
Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame
2. I have applied for I-485 and have EAD + AP.
I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this
1. Can I travel to India with AP when H1B extn is pending.
2. Will I face any issue while entering the US if my H1B is denied (or) there is an RFE on my appln?
Please answer these for me.
