Again you are plain wrong. If a non-US citizen buys house in the US then does he have the right to own the house and live as he wants? The answer is YES.
Similarly, the US Constitution protects certain rights of non-US citizens who are in the US. One of them is right to the Equal Opportunity Employment. Now if a law is passed such that it intentionally or unintentionally goes against the right of the US citizens or non-US citizens, employed in the lands of the US, to Equal Opportunity Employment then YES the US courts can rule that the law is unconstitutional and hence no longer applies.
The Key Point: Equal opportunity employement advancement is protected by Constitution ("Title VII of the Civil Rights Act of 1964 (Title VII)") and hence the Supreme Court can overturn the per country quota limitation if the Supreme Court finds that the per country quota leads to discrimination at employment, which is unconstitutional.
Unfortunately, I agree with you, this thread is going no where. It will go on for 10+ pages and then die. I have seen may be 5 such threads on immigrationvoice and .
You are talking about rights as if you are a citizen of this country. Constitutional rights are given to the citizens of the country. It is not your right to stay in this country. Legally it is your employer who wants you here and petitions for your Greencard. Now can you get your employer to talk to your congressman or media or file a lawsuit for you?
There were some folks talking about lawsuit 3 months ago after the visa bulletin. That thread ran 9 pages and nobody did anything. 2 months ago again people talked about lawsuit and hunger strike. Nobody did anything. So it is not going to happen. Are you willing to spend thousands and keep going to courts or testify? Are you ok with your greencard application be used as an example and allow USCIS to scrutinize it?
This talk about lawsuit is all gas.

[QUOTE=chaanakya;333554]3. You seem to be under the impression that IV got the visa-bulletin reversed??? Moses, wake up and smell the roses. The massive class-action lawsuit being pursued by AILA, the Silicon Valley lobby pressuring Zoe Lofgren, almost all immigration lawyers asking people to join the class action .. what about all of that? Do think your 25 bucks on the flower campaign is what got the bulletin reversed?
SERIOUSLY?? QUOTE]
You just woke up and asking others to wake up? A cat like thinking?
Chaanakya has a great name and you spoiled it too. If not for money, can you list your contributions and it helped others?

I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.
Another perfectly valid reason - thank you for helping someone go in your place :)
I can guarantee first hand - those CA to DC flights aren't cheap

As Chanakya is still getting rave reviews :) let me break this down a little more. OPs gripe can be broken into three categories:
1. What is IV doing with all the money collected.
2. What is IVs specific plans for the future/ what has it done in the past
3. Donor forum and general compliants about the concept
# 1. I think trusting IRS and CPA will go a long way. I am not aware of any donations being collected by IV on personal names. Have you sent any money to an individual and not IV the org ?
# 2. About us lists items that IV has done in the past. Do they meet your expectations ? Maybe yes or maybe no. What does advocacy mean ? For both the points, doing some research will help. Why we did not have stellar succeses with past campaigns ? Advocacy, how quickly can we be successful. Google and find out.
#3 Donor forum. Search the forums and find out how much money was collected by campaigns mentioned by ChanduV. Pennies. Two different reasons in my opinion as to why the donor forums have been created. 1. obviously to collect donations 2. the section has 'premium' content like regular updates, quick responses from core, information which cannot be made available publicly without harming the efforts etc.
All the other things about donor forum is nothing but emotional garbage.

To add to this.. Some will think that something good just going to happen since next year is election.. Not sure what makes them think that..
Some are extremely negative-- They will say doesn't matter what you guys do,nothing will happen.
Those with negative opinions - they do not do much in life too - most of these wake up late in morning, go to work, watch TV , lazy in weekends , play cards, chat on phone , always spend a lot of hours on the internet researching for some crappy deals on electronic goods - the time, if well spent is worth more than what they save on buying the item.
Though it is difficult to change their attitude - it is possible, we must be persistent in our effort.

Though your feelings are ok, the reality is different.
1. yes there are lot of capbale people through out the world earning less than what an average person earns in US. Why any country should provide visas to them if the country does not gain anything from it. Better to know the supply Vs demand concept.
2. Being a very capable person, you choose to be on H4. US did not force it on you. Everyone has the option of going back to their home country or wait here till they get what they desire. You weigh both the options and decide which suits you better. If you decide to stay on H4 for 4-5 years, then at somepoint for some reason you thought it is better than going back. So be practical.
As someone said, one should feel deserved to get GC and not beg for it. Again I am sorry for your status. My wife with CA and CPA and she is on H4 for 5 years now. I know how frustrating it will be. Worrying will not help much. Accept the reality and think calmly which way you want to go in your life down the line in next 5 years. Take actions now for that which may end up in leaving this counrty or staying with current status until you get GC. You have to make up your mind to live a peaceful life.
This GC process will throw anyone into depression.
Good luck.

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. If demand for EB3 ROW is still low, then final quarter of this fiscal year (Jul to Sep), priority dates for India EB3 can possibly see a jump forward by 1-2 yrs.

I dropped the letters in my garage yesterday and thought I had picked them all up. But there were few that were hiding under the car. And this morning they came under the wheels :(
Trying to see if they can be revived and cleaned up.
That is not fair. I hope that you can use them, for all the effort you have put in.

I just got laid off.
I am an EB2 (Jul 15, 2007 priority date). I jointly filed my I-140/I-485 5 months ago (1 month inside the 6 month period to become 'portable'). I was at Merrill Lynch; they said they do not typically inform immigration of laid off employees and the lawyers feel that I should still be able to get my I-140/I-485 (hence, my greencard) desp. They said, due to the current economic conditions (and subsequent large numbers of layoffs) US immigration is not to 'stick'y on the 6 month requirement for portability.
Does this sound plausible? Is there anything I need to be aware/careful of? Does it seem likely I will need to start my greencard (PERM) process from the beginning again?
Your knowledge is urgently appreciated. Many thanks!!

I have majored in Information Systems from New York, however, I am have a BS and not MS. I been for 6 years on H-1 by now. Does it qualify for any of the SKIL bill's previledges?
I think you will have some benefit out of this bill, albeit, indirectly. This Bill will exempt a lot of folks with advanced degrees from US and non-US universities. All advanced degree holders from US univs. (STEM and non-STEM) will be exempt. So, a person with an MBA flus a 4 year bachelors from a US univ. will be exempt. Also, folks with non-US STEM advanced degrees who have been working in the US in a related field for 3 or more years will be exempt as well. The family members of such folks are exempt as well. Consequently a lot of folks currently waiting in the pipeline may no longer be counted against the quota, thus reducing the clog in the pipeline. ANother benefit out of this bill is that it increases the quota from 140K to 290K. There fore, you will definitely see some positive movement in priority dates for people in your and other similar situations (this is the indirect benefit I was referring to). It is very hard to say at this point how much the positive movement would me. It will all depend on how many people will be exempt from the quota.

Transfer H1-b (dont have to apply for a new one)
: THIS IS COMPLETELY WRONG
I already posted this in another thread and I will post it again:
I am wondering when people will understand that H1B Transfer does not exist!
Everytime you want to switch employers, a whole new H1 must be filed.
People are always under the impression that because they already hold an H1, then it is easy to get "transferred" to another company.
In this case, the only thing you actually "transfer" is ...yourself and nothing else. The only advantage of already having an H1 is that you don't have to worry about the quota anymore, you are exempted from it.
Since you have to file a new case, approval can never be guaranteed and it is therefore always risky to switch employers (as soon as the new H1 is filed), without waiting for approval. Tricky stuff...
Check this from Murthy.com:
" Among the questions that often reach us, are those regarding H1B status and changing employers that refer to "transferring" the H1B. This term is frequently used, even by some immigration attorneys. The H1B is not actually "transferred" from one employer to another when an individual changes a job, however. We understand what people mean when they refer to an H1B transfer. We take this opportunity to explain the concept, though. This should help our readers to avoid misunderstandings as to procedure and requirements based upon the mistaken belief that the H1B is somehow transferable from one employer to the next.
MurthyDotCom
When a person is on an H1B and plans to change employers, what technically is filed with the USCIS is a new H1B petition, reflecting a change in employment, generally with a request to extend H1B status. Again, with the exception of the foreign national employee, there is nothing that transfers from one employer to the other."

Yes, what I posted was meant to be hard,
ask a EB3 person if he was happy when EB3 was available and Eb2 was not.
Did any one try to justify the reason why EB2 was UNAVAILABLE? No.
Did anyone here feel unhappy that EB2 moved so nicely? No.
Then why are we not seeing a single post from anyone which says we as aspiring immigrants are not being failrly dealt with when EB3 did not move with EB2.
Instead we see posts about why EB3 is not moving and explanation of reasons behind it.
Is there a hidden agenda here, NO. Not from IV, am i trying to prove something like that? I dont think so.

Hi Totoro,
please be so kind and explain me what exactly shall I say to the SSN Office about why I apply for SSN non-work. If they ask me to proof that I need a SSN to get Economic Stimulus Payment, what shell I do??
How is posible to get a SSN non-work to get Economic Stimulus Payment if you didn't work. How can you make tax return without to work. ?? Sorry for all this question but I really don't understand. But i'm shure that you will be very nice and you will explain me how it's work.
Thank you,

As long as you qualify for the stimulus payment, you can get a non-work SSN. You qualify as long as you are in the income levels specified, were a resident of the US in 2007 (substantial presence), and were in the US legally (have a valid visa). If you did not file a tax return, then you cannot apply for the SSN.
As far as the Social Security Act is concerned, the law states that they MUST give you a SSN if you qualify for any federally funded benefit. The question is: Is the Economic Stimulus Payment a federal funded benefit. The information in my original post makes a very strong case that it is.
Please post your experiences here, even if you are denied. Remember, the folks in the local SSA offices are bureaucrats, not lawyers, or judges, so don't expect much cooperation. However, if they deny you application, simply write them a short letter saying that you disagree and that you are requesting a "reconsideration."
please be so kind and explain me what exactly shall I say to the SSN Office about why I apply for SSN non-work.
Thank you,
lelica

I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. part of the reason is that IV is originally indian club. we got the message but kind of lack the close organization.
anyway, I am also thinking about another rally.
1, it has to be on weekends, so everyone can come
2. it should be in multiple cities, from coast to coast, all major cities.
DC. NYC, chicago, LA, SF, houston, boston. reserach triangle, seattle etc, where professional immigrants lives most.
3. we need to make sure everyone will come, need good personal organization, not just voluntarily, we need personal contact, conversation, meetings ahead, level by level, to build a good "relationship" with each other.
yes, this is the hard part.
4. we really need to study the illegal immigrant rally last time, how successful they were !!!!
5. honestly, we didn't get much media coverage. shame ! nothing on TV, newspaper frontpage. but--- if we have a huge rally, everyone will have to cover us, pay attention to us. it all depends on us.
Love you guys
we should hurry up
Dear Elle, 谢谢! for coming and 我们来自许多国家不仅印度! :) For example, I am from Europe/Mexico (long story lol) We need to bring in more of our Chinese friends! What do you suggest? What Chinese organizations can we contact to join with us ad how to we best reach out to our existing Chinese IV members?

nope didn't send photos
So, no way USCIS can give you EAD before you appear for FP. I am in same boat.
They need latest photo. As per requirement it should be taken within 30 days of filing the application.
