First of all I think logiclife will go in the history of immigration books as the movers that existed in this generation. I am amazed at how motivated the IV core team is and how smoothly they have organized the whole show so far.
I salute you. Hats off to you guys.
I read a lot of newspaper articles after the rally and they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities such as Russians, Englishmen, Philipinos, Chinese and other nationalities. Now I know they are not hit as hard as us but they go thru some serious backlog as well if they are in the EB3 category.
Question is I am thinking how?
Any ideas guys?

If there is any progress on this please let everyone know. I also tried and was refused by the SSA for my wife's SSN.
I would be willing to contribute in any way possible in this case... and that's not just for the money. I feel the spouses on H4 visa are heavily discriminated against.

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.
I would give some days to Attendees and particularly to IV core team to analyze the rally events, meetings in their entirty and come up with the conclusions mainly for 3 things. And I request everybody to funnel data to core team centrally and the same way conclusion and future action list funnelled to members.
- What we could REALLY achieve
- How loud we could be heard
- Any potential and positive impact in near future?
- Based on all of above making near future strategy

Looks like USCIS is sending more denial letters on AC21 cases these days, a lot of VOs may not have been trained on AC21.
I took infopass this week to find out status of my case (AC21 responded to NOID and case reopened and lot of soft LUDs) - the VO was trying to be judgemental instead of looking at computer and answer my question. She said "If you change job and 140 is revoked, there is no way your 485 will get approved" and when I insisted her to look at computer and let me know status, after some nagging, she looked and told me case is pending and NC cleared and I will receive a decision sometime but not very soon.
Believe me, a lot of VOs do not know AC21 stuff.
In such cases, where the InfoPass people (IOs or VOs or whatever they are called) pass judgement on whether your 485 should be approved or not, does it help to bring a printed copy of the AC21 Aytes memo (issued in Dec 2005)along to show to them? It is an official USCIS document and it clearly states the following.
Question 11. When is an I-140 no longer valid for porting purposes?
Answer: An I-140 is no longer valid for porting purposes when:
A. an I-140 is withdrawn before the alien�s I-485 has been pending 180 days, or
B. an I-140 is denied or revoked at any time except when it is revoked based on a withdrawal
that was submitted after an I-485 has been pending for 180 days.

EB3 (India) moved 2 months. Good news. But then?
What you expect for Eb3 guys? What may be the trend in coming months?

I dont think many labors were filed between september 2001 and Dec 2002. Due to bad market and frequent layoffs during that time. My guess is EB3 will get to 2003 soon, may be before end of this year.

Its good that we have a democratic majority in congress. we also now have work cutout for us to contact new lawmakers. getting more members and members willing to work for local chapters is important at this time. we need to work with renewed vigour now and finish our task. pls help with increasing membership and join your state level chapter threads. I see only very few members have posted their interest. we need interest from each member in order to succeed. I am sure we will succeed. The good times are ahead of us but we need to take advantage of it.

Ok..I know I should read thru the older posts, but didnt get a sense of what is required in my case, so I am posting the question online.
My wife was on her independent H1B. she travelled out side the country and was readmitted on H1b. After that she turned in her 2 weeks notice and has started working for another company on her EAD.
We have not applied for our AP previously.
My question is this:
In Part 1 , Q3
Class of Addmission
Should she put H1B (last admitted as)
or would it be Adjustment of Status (since she is using EAD)
Also, what kind of supporting documents need to be sent?
I-485 copy
EAD Copy ( yes/ no)
I-94 H1B issued at POE (yes/no)
2 passport sized photographs?
anything else?

In my home country, you are *supposed* to list your age on your resume. I am not kidding. They don't consider your resume if you don't put your age there. If I go back there in few years from now (I am 34 now), I am not sure I would be successful there anymore.
Folks, we are in a very difficult situation. Our careers are in grave danger. I was planning to wait for GC to let potential employers pay my masters degree, but no way. I already submitted the paperwork to resume the sucker MBA this Fall and pay the whole thing from my pockets. Either that or I should trigger AC21 very soon.
If the October visa bulletin shows EB3 World stagnated or retrogressed, you can bet a Starbucks coffee I will be looking for another job/AC21 very fast.
Some people advise to wait and watch and some people ask to do something else. I would like to say one thing and it is purely my perspective. People who are waiting inline for 8-10years does not know when they will be getting their GC in hand. May be in next four to five years. By that time on average their age will be around 35-45.
Do you want to wait 4-5 years and do the job which you were doing 10years back?
Did you had any vision for your career when you started your GC and life?
Do you have the same vision now for your career and life?
Did you feel you and your family have sacrified enough in your personel life for this stupid GC?
IF YOU SAY I HAVE DECIDED TO GO BACK TO MY HOME COUNTRY:
Do you think you will get a managerial job if you go back to india at the age of 40 when you could see guys @30 doing that job with ease and with better experience?
Do you think becos of 10+years of expereince in programming field, indian companies will recruit you for managerial job?
Are you willing to work in India as a programmer with 10+ years of US exp under a 25-30 year old team lead or PM ?
If you say YES , YES , YES for all the above, do you think any indian company will recruit a programmer at the age of 40? forget about the salary you are going to ask for your exp which they will never accept.
So at the end if you wait long enough for GC, then it is better to wait here until you get it. At least you can save your life though you have to start your career from -10years. If you quit and decide to go back to your homecountry, your life is going to be tough.

1. Try to get PMI Certification, CISA certificaiton.
2. Try to get TOEFL, GMAT scores and keep it ready.
3. Try to get in contacts with most of your friends and manpower agencies in India.

5. Your waiting will yeild fruit in this country only with MBA as in next 10 years, US will need more managers than programmers to manager all their outsourced projects.

If you do not have such vision and you are happy with what you are doing now and if your job is secured for next 100years and if you feel that you will be happy in future by doing the same job and OK with other kids going up the ladder stepping on you and if you are ok reporting to them and listening to them, getting bashed by them etc etc, you can very well wait for next 100 years hoping to get GC one day.
I am not talking about one guy in one corner living beautiful life.
I am not talking about guys who are lucky on everthing to get on time including GC.
I am talking about majority of the people and general human nature, people who came to US with a vision for their career and life. People who have had and has a spark in their eyes.

Since it is orginating from house. Also It may not be passed as it is. Subject to Amendments. For example there will not be oppostion to increase of h1 to 115k. But market based adjustment will have some opposition. In fact I heard one of calfornia Senator is opposing flexiblity of the Cap though she is accepting that h1 cap should be increased. Some debate also will be there in both houses and Senate has to vote again. Also EB category will have permanent increase in immigration, a few weeks of debate will be there. But we have to see how much oppostion will be there for EB immigration increase though there will not be much oppostion to H1b. Last year anti immigrants worked in backdoor and successfully delayed the the bill so that it can be killed. But this time also they will try to delay it because they cannot oppose the bill directly. Anyhow it may happen before this year end. Immigration is emotional topic for Americans as they fear their jobs are in risk though it may be or may not be true..

I am not sure if it is only me.....but many times I see strangers wishing me or each other morning, evening...."how u doing" ,,,etc....
but Indians (I am also an Indian -:) are a little reserved....I do not see a greeting from fellow Indians that easily.....again I am not saying Indians are bad (cause I too am one -;)
maybe it is a culture thing for us not to greet strangers ?

Eb3 v/s Eb2 is a nonsensical nonproductive meaningless argument. If you actively participate in speaking with the lawmakers, you would know the bogus nature of this squabble. Each one of us has a choice. We can continue with this pissing contest or we could do something to fix the backlogs. We all understand the frustration and anxiety due to the long delays. It is easy to be drawn in meaningless eb2 v/s eb3 quarrel in the virtual world when one is not privy to how things work in the real world.
If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.
Members who actively engage in the advocacy effort know when we are saying. For example � talk to nearly 125 IV members who lead the lobby day in DC during the past week. They will tell you the bogus nature of this Eb2 v/s Eb2. Stop wasting your energy arguing thing which have no meaning. Please utilize your energy in finding fix for the backlogs because there will never ever be a bill/set of provisions only for Eb3 or only for Eb2.
Understood every point of yours & I stand by what you said except for the language as it could have been a bit better. Regarding EB3 or EB2, maybe IV should work attaching a provision as part of its CIR work, which makes USCIS determine whether a candidate is in EB3 or EB2 based on the PERM & 140 instead of letting companies & attorneys mention it. If this happens the process will be much better as USCIS controls the categories & applicants do not need to beg a company to throw them into an EB2 basket or EB3 basket. Also, applicants can have certain amount of freedom from the companies.
When a process is flawed, there is always room for abuse. Of course, the abuse might be minimal, but when we see people with masters & 15 years of experience toiling in EB3 category it pains my heart. Because if we request members to put their time and effort then it would be mostly EB3 members as they are the "worst" affected. If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.
Members who actively engage in the advocacy effort know when we are saying. For example � talk to nearly 125 IV members who lead the lobby day in DC during the past week. They will tell you the bogus nature of this Eb2 v/s Eb2. Stop wasting your energy arguing thing which have no meaning. Please utilize your energy in finding fix for the backlogs because there will never ever be a bill/set of provisions only for Eb3 or only for Eb2.
Understood every point of yours & I stand by what you said except for the language as it could have been a bit better. Regarding EB3 or EB2, maybe IV should work attaching a provision as part of its CIR work, which makes USCIS determine whether a candidate is in EB3 or EB2 based on the PERM & 140 instead of letting companies & attorneys mention it. If this happens the process will be much better as USCIS controls the categories & applicants do not need to beg a company to throw them into an EB2 basket or EB3 basket. Also, applicants can have certain amount of freedom from the companies.
When a process is flawed, there is always room for abuse. Of course, the abuse might be minimal, but when we see people with masters & 15 years of experience toiling in EB3 category it pains my heart. chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining. Now it's only fair that you don't complain when people making additional sacrifice are given some recognition. Don't mistake...those donors also make all other forms of non-monetary contributions. Have patience things will work out slowly but surely.

I agree we do spend a lot on the GC process. It's painful to watch the inefficiency of USCIS after paying so much. How much ever we paid for GC process, India trip etc., are unlikely to buy us any sympathy from the Law makers.
We could get asked questions such as 'if it's so expensive and inefficient why did you apply for it?' and 'why do you guys need to fly to India every year?'. People are interested in only the figures that affect them directly . That's life!
We can, for sure, catch their attention if we can show them in real figures how much Federal and State Taxes, SSN , Medicare etc. we have paid as a group. Are these figures avaible today? Forget about how much we are paying to the US economy - is there any real figures available on how many EB GC applicants are in Michigan?

We need to collect and collate these figures. Present them to the Lawmakers and Media to make our case. I have an idea about it. I will be proposing at the meet to gather others opinions. Once we have an internal agreement and a solid plan, we can propose it to the Core for their sanction.

Just consider howmuch we spent on GC filing?I personally had to spend for filing and attorney and medical approx 7000$ (ya i had to use my company attorney as my labour was approved in last time).If atleast 200000 people did spend atleast 5000 ,then see how much we spent .Atleast 1000,000,000 dollars inside America during June to August 07 out of which atleast 50% to USCIS for something which MAY OR MAYNOT happen after years.And again a confirmed money 1500-2500 dollars every year for attorney+uscis fee for EAD and AP.The figure which i mentioned is just for an example,the actual figure might be twice.
In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute.And yes we pay for SSN,medicare for americans to enjoy at florida after 60.

I dont know about others but for me Fragomen has been very responsive. I think its probably your employer that is dictating how the attorney should deal with their employees. I work for a big fortune 50 company and I always got email responses from my fragomen attorney within 24 hours...that works for me.
Some times employers dont want their employees to get eads too soon, as they might jump the ship using ac21, and hence takes the help attorney to delay the filing, which works well for some attorneys too.

I am one of many many and happy to see this development.
I am puzzled.
Just would like to remind you all , only couple of months back, there was a great optimizm of CIR .. but today we know it is in stalemate.
So I think this time around we should be cautious. I have a question... What is the gaurantee that this bill is not to increase H1-B alone? Sorry If I am not being optimistic here.
I request, Our web faxes clearly state why we support SKILL BILL... If I read right and remember it well, this Forums goal is to reduce retrogression/backlogs.
Now to be positive I am copying an extract that was in quotes in press release ..

Excellent Point. Its defenitely not in any of the employer's interest to worry about EB issues. Infact they prefer people being in H1. and I certainly do not want to support that. There are good chances that congress increase H1 quota and we end up supporting the wrong cause. As far as IV is concerned, I would even go to the extent of saying that we should not support H1 causes, as there are enough candidates in H1 here undergoing EB problems. Thanks for bringing out an excellent point regarding this bill. My opinion is, if EB issues are not stressed properly, this bill will be viewed as "INCREASE FOR H1B BILL".. my 2 cents.
