I have been laid off yesterday. My employment ends Dec.
My 180 days expire Jan. My company said they will not revoke the I-140.
So can anyone explain the steps that needs to be taken by company B after they transfer my h1, for time period Dec thru Jan.
Can I use ac21 afterwards? and
Can myself or my wife work on the EAD that will come to our home address?.
What else needs to be done by company B.
Will we just get our green card in email.
If a query comes should I prove that I'm employed with the former company or is it to sufficient to show employment with similar position alone?

You should be OK as long as you don't get a query. If the query is for the I-140, just send them the information they ask for without explaining too much. Hello,
I have been going through this discussion. I am in a similar situation where I got a Welcome Notice saying my I-485 was approved and I should be receiving my card in 3 weeks when my PD is not current and in fact, the PD is a couple of years behind! It has been 6 months since I got the notice and no GC is in sight. After calling the customer service in March, they told me that they did not have my biometrics in their system and so I had to go for a biometrics appointment early April. It is almost 3 months since then and I still have no GC card. I know that there is a delay in card production, but at the same time, I am wondering if the I-485 approval was by mistake and that is causing the real problem. I am in talks with a lawyer who suggests it is better to correct the USCIS mistake right now rather than getting into complications in the long run. I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.
Could one of you who faced this situation descibe how you handled the situation or how you would handle this situation? In my case, there is no other I-485 or anything filed before and I have never been out of status or had any issue ever.

Even if they approve the GC, they can always revoke and ask you to return the card. This has happened somebody, I don't remmeber which forun I read about it. Call them up and inform them that your PD is not current. You can even go to local ASC and talk to an IO. If you have an attorney, inform him/her.

IV is more than a website. We are trying to build a grassroots organization. Things are taking place offline as well.
It takes time to build the base. Strengthening the state chapters is one of the best thing we can do. Our first chapter meeting was very small as well but we will build from there. More members are forthcoming to meet lawmakers now.

I didnt attend the rally because I thought there isnt much that would come out of it. The expense was too much to fly from CA. However, if it was in the BA I would have gone...
mrane1, zerocomplexity, jay75: You know that CA had (one of or maybe THE) the biggest contingent at the rally. Besides, help was available to get you to the rally from CA or WA or OR.
A lot of us including myself flew on the 18th and returned the same evening, and a lot of us, again, including myself were part or fully sponsored by others who could not make it for personal reasons.
Of course, if you thought there is not much that would come out of it... it is a different story. Maybe you should look at the positive energy that every one of those 1000 souls is brimming with.
Need to call or faxing senators when the next bill about legal immigration comes to discussion? Oh ... that is a piece of cake if you ask any of these 1000 souls who made it to DC and proudly marched beneath the Sun shining over the capital of the nation!

What are we supposed to do now?? we should make this an IV campaign issue. USCIS is not following the rules set by congress. AC-21 is the law and USCIS is not following the law and causing hassel to the legal immigrant community. The legal immigrant community should really do something about this.

I was told that people on H4 are not eligible for SSN, and if I want she (the person on counter in ssa office) can issue me a denial letter for that. It sounded useless to me that time, so I didn't bother to get that letter.
This idea sounds good to me, I'll go to SSA office again and try to apply. Offcourse they will say that they can't accept application. So I'll get a denial letter and I can appeal against that.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. At least that is my motivation.
In my case, the first time I called, the person hung up on me. But I did not give up. I got them to accept the application and it is currently under reconsideration. I was also able to get a response from the Regional Office. So far they have not addressed any of the points I made in the original case as described in the OP. I expect they will continue to ignore their own laws and regulations, until I appeal this to an administrative judge, who will make a legal ruling.
BTW: All this costs you nothing but your time.

Also I heard that you can collect SS if you have paid 10 years SS tax even if you don't have GC/ citizenship at the age of 60. If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.
For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.
What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take the greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. I feel a need to provide this forum with another view, which many times I believe is the correct one. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

The reason some of us long timers at IV are ired with the Ombudsman is because this drives us off message. We end up discussing non relevant topics.
We have one goal. Relief for thousands of us who are stuck in limbo because of antiquated immigration policies for skilled immigrants.
Today is a good day for us. Why? Because any change is better than the do nothing congress before this one. We need to be energized and reinvigorated to take this race to the finish line.
In times like this the Ombudsman is a distraction. His views are a distraction. When you start feeling helpless or get the age old feeling that nothing will happen, you have lost the battle.
We have one goal. Relief for thousands of us who are stuck in limbo because of antiquated immigration policies for skilled immigrants.
Today is a good day for us. Why? Because any change is better than the do nothing congress before this one. We need to be energized and reinvigorated to take this race to the finish line.
In times like this the Ombudsman is a distraction. His views are a distraction. When you start feeling helpless or get the age old feeling that nothing will happen, you have lost the battle.
