I have tried to convince people (Indians and some Chinese) to join IV. People don't. They don't believe IV has the capability to get anything done. A lot of people don't care if IV existed or not. They believe that Congress will get to it when it deems right. Core members were asking a few weeks ago if that is the message people are sending. Yes it is.

If that harmful provision had stayed, then the new quota of 650,000 in S 2611 would have been useless. People forget achivements of IV or think that it was negligible. Retrogression would have been exacerbated with hard country cap.

I am not a leader and I don't want to pretend that I am. I ask others who are not to step down and encourage the right people to take leadership positions.

If you take leadership, you need to do things locally like meeting with other people in your city, forming a group of 4-5 people and going and meeting your congressman. And if you want to be in IV core, then you have to call us on the phone number listed and we can see if you can add any value to core by doing things we routinely do, like content prep, website maint, travelling to DC for meetings, talking to other orgs etc. If you are up to the job, sure, why not. Anyone who considers themselves fit for IV core, please call us. We really do need help as we are overwhelmed.

The same thing that has caused us to fail last year, the same thing that caused industry to fail in getting H1 quota raised, the same thing that caused failure of Universities to get F4 visa for masters degree holders. And these guys have lobbying budget in millions? Why do you think they failed?
Whatever caused their failure, caused our failure too. In DC, issues are not debated and legislated based on morality and merits of those issues. They are taken up based on contemporary politics and other factors like lobbying, public attention, elections and political parties.
For example: Last year, they debated a constitutional amendment to ban flag burned in USA. And spent precious time of congress on debating it. How to you think that would have helped anyone? Even it had passed, what was the merit of the issue? Flag burned mostly happens outside USA. In USA people rarely burn US flags. So banning flag burning in USA is like banning metric system. Its meaningless. Yet, they spent time on it.
Read papers, read articles from other lobbying orgs and learn something. Legislations dont happen on their own because the issues carry weight and have merits. Merits have nothing to do with congressional action.
To quote a bestselling economist Steven Levitt :
"If morality is how we would like the world to work, economy is how the world actually works".
Same thing applies to US congress. They dont set their timetable of bills based on morality and merits. There are other factors.

If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).
You can also check the application receipt date on them.. see if they are around April of those years? Most probably they will be new filings if the receipt date is around April oppose to September or November.

How does passing CIR help us? I didn't really have the energy to go thru the whole bill but it didn't specify what "line" those 20+million ppl who eventually get amnesty will be processed in. If they line up on EB3 or a supplementary bill in the future decides to allocate some EB3 to a "Schedule B" (just for example), then we are right back to where we started (but add more years to the waiting).

even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
i would be very careful about making such an argument.
if this is true in IT then the opposite argument is perfectly valid (and that is the one USCIS/DOL will accept) - that the folks in EB2 are not doing a job that needs an advanced degree and they should be in EB3.
and if this is true:
"If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
master degree or 5 years experience."
then maybe applicants and their employers should start shouldering some of the blame for the current backlog instead of blaming everyone else.
i have no personal knowledge of this. in my field, there is no question that an advanced degree in needed. in fact, something well beyond it is the standard qualification.

As I mentioned, "many" and not "all", I stand by my statement. Those paying taxes ( using fake SSNs) are in high-paying jobs like construction. How many of those waiting eagerly waiting for a job outside HomeDepot, you think, pay roll taxes? Not to mention low-paying jobs like fruit-pickers, cash workers in restaurants etc.

Based on the wording of the visa distribution law, it does not look like the pattern change is a permanent one. The pattern might change again as per USCIS whims and fancy.
Read the part "Nothing in this paragraph shall be construed to limit the authority of the Secretary of State to determine the procedures for the processing of immigrant visa applications or the locations where such applications will be processed."
That's was my earlier post to vldrao meant. This might be a make-shift approach to use up the visas for this year only. The predictions we are doing for next year(s) might not be true..we should just wait to see how things start rolling next month and if something is published for rule change from USCIS/DOS.

I am also, stuck in this whole BEC debacle. Mine is Oct 2003 EB3 and still stuck in Labor. And the very fact that the FY 2008 quote availability is very uncertain and we might not be able to apply for I-140/485 for years now makes it even more frustrating.
I am new to this team, so please tell me what I can do anything to help this issue to be raised.

Thanks, Andy. So, 80K LCs a year, 10%-15% of them will probably never get to AOS stage, 20% of those were duplicates (for people with petitions stuck in the backlog centers), so we are talking about 50-55K new labor certificates each year that will result in I-485. This is very consistent with 85K new capped H1Bs plus whatever number of exempt (non-profit research) H1Bs every year. So, we are talking about 100-110K total AOS applications (with dependents). Now lets take 140,000 EBs, substract Schedule A and EB1 (no need for LC), and there is probably 10K extra EB visas should be left over each year (quota less new potential EB petitions). Those are probably going to land in EB3 ROW. That means the retrogression will become less severe. What we are experiencing right now, is the rabbit that moves through the snake - the EB petitions resulting from a higher H1 cap several years ago.

I requested (actually begged) my employer and attorney to pursue EB1 as well - they said no - lawyer's response is EB1 is very difficult and you should be someone of nobel prize calibre etc.etc.

If your employer's lawyer had to file EB1 on your behalf, she/he had to do this in either EB1-OR ("outstanding researcher") or EB1-ET ("executive transferee") category, depending on whether you are employed in academics or industry. That may mean more paperwork for the lawyer and/or expense for the employer, which might explain their reluctance in pursuing that option. And in general, a lawyer hired by your employer does not always have your best interest in mind (unless it coincides with the interest of your employer).

Q: Can an employer cancel H-1B visa without employee�s knowledge/consent?
A: Yes and remember it is illegal to travel on a cancelled visa.
