Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
Does these levels matters, when it comes to adjudication. please anybody clarify my doubt?:confused:

I agree we do spend a lot on the GC process. It's painful to watch the inefficiency of USCIS after paying so much. How much ever we paid for GC process, India trip etc., are unlikely to buy us any sympathy from the Law makers.
We could get asked questions such as 'if it's so expensive and inefficient why did you apply for it?' and 'why do you guys need to fly to India every year?'. People are interested in only the figures that affect them directly . That's life!
We can, for sure, catch their attention if we can show them in real figures how much Federal and State Taxes, SSN , Medicare etc. we have paid as a group. Are these figures avaible today? Forget about how much we are paying to the US economy - is there any real figures available on how many EB GC applicants are in Michigan?

We need to collect and collate these figures. Present them to the Lawmakers and Media to make our case. I have an idea about it. I will be proposing at the meet to gather others opinions. Once we have an internal agreement and a solid plan, we can propose it to the Core for their sanction.

In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute.And yes we pay for SSN,medicare for americans to enjoy at florida after 60.

I guess it's not about service. It's about job professionalism. There is no problem with Air Hostess or employees, but it is management. Let me give snap shot of my exp.
My flight was from Bangalore --> Bombay --> USA
Flight took off at Bangalore 60 mins late. Staff reassured that flight in Bombay will be waiting
Once we reached Bombay they took boarding passes and tore them off. They said your flight already left, you have to go next day. Some passengers noticed that few passengers are still boarded into US flight with flight nbr given in our boarding passes. When everyone made an issue about this they said, it's overbooked so we can not accommodate.
So their statement that flight took off was literal lie which is unprofessional. Also they deliberately delayed Bangalore flight which also they did not manage nicely
Then they said go to Delhi there is a flight. We reached delhi there is no flight. There AI staff said not sure why they sent you here. Only option is next flight starts tomorrow. Next day they listed the flight but again they say it's cancelled due to technical difficulties and part has to come from other country and you can fly only tomorrow.
By that time there were passengers of 2 days waiting. when every one made a big noise, they arranged a flight after 4 hours.
They should have made alternate arrangements before all this mess and 2 days of waiting. Consider people with infants.
I understand unfortunate things happen but deliberate lies due to mismanagement and moving you around just to buy time is completely unprofessional. I did not find this kind of unprofessionalism in other airlines, even though there are other bad experiences with them also.
similar incident happened to my room-mate, may be little worse.
The airline was aerofloat (russian) in this case.
they boarded aircraft from bombay to ewr. aircraft started running on runway and after some unsuccessful attempts they came back to terminal. with everyone's surprise, the pilot announced that there is a techincal difficulty and unable to takeoff.
Next flight was after 48 hours and that too from delhi. No need to say my friend spend 24 hours also at moscow airport and finally reached newark after 4 days finally. All these with no ground staff at bombay by aerofloat. Being young students, my friend and his groups helped like a coolie to shuttle all other elderly passengers bags to hotel and so forth. He is a very fair person and still doesn't blame aerofloat. He bought the return ticket for 760 with tax, where other airlines used to charge like 1200 or so.
morale of the story: don't blame airindia for all the faults. I am sure there is lot to improve but it is not the only airline where things go bad. This is possible anywhere.
and lastly, the OP who blamed airindia for not allowing duty free stuff bought at NJ at frankfurt - don't blame AI. It is the airport staff of FRA and not AI.
For all those who think that only airindia is bad, go to google and search for reviews of any airline. Chances are very high that you will get such horror stories described by someone.

I think very few people will disagree with the fact that EB2 I will retrogress in OCT. Reason for this is DOS always tends to take conservative approach to set the cutoff dates in the first and second quarters.

Guys, this is by far one of the best points ever made in this forum. This is actually our silver bullet. Open the eyes of people around the world that the US is not treating skilled immigrants right anymore. There are many countries out there which offer more career opportunities than here. By the way, what am I doing here?!

I got my M.B.A in a prestigious US university and worked as a Financial Analyst in US for two years. I was thinking of applying for GC at that time because I had planned to stay in US. But, that winter, when I took a vacation in China, I decided to look for a job in China because I was very impressed by the economic development in China and wanted to capitalize on the opportunity. The Chinese market was/is in urgent demand for US-trained financial analyst. After some interviews, I got a very generous offer from a multinational company and quitted my job in US without any hesitation.
Now five years has passed. Because of my excellent performance, I get two promotions in the past five years and am a director in my company. My boss, who is an american, lost his job and has to go back to US because my company cannot see any fiancial advantage to hire him anymore. I have never been happier. I believe that I made a very good choice five years ago. Most of my chinese classmates during MBA study are still struggling for their GCs and get stuck in their career development because of GCs. They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

hang in there buddy, as others have already suggested just wait for the notice and file MTR. tough 10-15 days but after all this is over you will forget about it. I was in a similar state when I got a RFE on 140.

Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!

Does any one has any Idea or back of the envelope calculation as to how many EB2 visas (for all countries) may be left for the remainder of FY'07?
The reason I am saying Eb2 all and not EB2 India, as most of the 485 applications filled in early July 485 were from India. Hence, given the new interpretation of visa overflow, almost all will be assigned to this category.

Sorry guys, I was in India for the last 2 months...family issues..etc...but congrats on a successful rally, I notice people are talking of another rally, here are my 2 cents :
1) Although the rally made news, the fact that ONLY 1000 people attended is not enuff for national coverage and common man- news.
2) A second rally should not just be one rally, it should be a rally across the country, every state, city, street. Fix up one date and one time where everybody in each state/city can meet, if you live in falls church and have a volunteer to organize the meeting, meet up there with some slogans, if u can do it downtown NY with even 100 people, thats great..but it all has to be co-ordinated, just think of the impact if at 2PM EST, 11AM PST and 12PM CST on one particular day... every legal immigrant worker is on a rally and this gets publicized..i know it sounds far fetched...but little wonder, the illegals all gathered up in large numbers and were able to get legal in 2003-2004....can we educated folk learn something there ?? i can volunteer for my area (west coast, southern california)..any takers ?

Agreed immigration is benefit. But immigration laws should apply equally. It cannot be the case that people from only few countries are retrogressed by 5 more years than the people from all the other countries, which causes people from few countries to be at disadvantage at work

Good Luck with using that argument if that is your legal basis.
Fair does not necessarily means legal.
Example:
Two person have approved I-140 and waiting for visa number to be current. One is in the USA and the other one is outside USA. The one in the USA can keep on extending H-1B while waiting to file I-485, whereas other person has to wait to get green card at consular processing. Is that fair? For some, it may or may not be.
Immigration Laws can not be challenged in court on basis of fairness. However, with lobbying, laws can be changed.
Personally, I think the country quota is discriminatory and should be removed for EB based green card. But this can be done only with law change and this requires long and persistent lobbying, time, and monetory effort.
In any fight, it is always prudent to use effort and energy in right direction.

Good Luck with using that argument if that is your legal basis.
Fair does not necessarily means legal.
Example:
Two person have approved I-140 and waiting for visa number to be current. One is in the USA and the other one is outside USA. The one in the USA can keep on extending H-1B while waiting to file I-485, whereas other person has to wait to get green card at consular processing. Is that fair? For some, it may or may not be.
Immigration Laws can not be challenged in court on basis of fairness. However, with lobbying, laws can be changed.
Personally, I think the country quota is discriminatory and should be removed for EB based green card. But this can be done only with law change and this requires long and persistent lobbying, time, and monetory effort.
In any fight, it is always prudent to use effort and energy in right direction.

Congratulations and enjoy your green card! Don't worry about the priority dates not being current when yours was approved. My green card was approved in September 2007, sometime after the July fiasco wherein the PD for all categories became unavailable. Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

I just called and got a similiar very supportive response from the staff. She mentioned that she is getting a lot of phone calls about the 3 bills and will let him know about it. Go IV Go :)
I just called and spoke to a staff member at Lamar Smith's office. Apparently a lot of calls are being made :D. She knew why I was calling before I could tell her. I was told that the Rep. has not made a public stand on these bills yet. I told her that I would like the Representative to support these bills if and when they come to the floor.
