I have flown in these airlines so far and here are my comments
Delta - Oh sucks man !! - Thiruvallur bus (in tamil it means - a normal congested government bus)
Qatar airways - decent - except for the food which is no good and you dont get the polite service (even they will not even check back if the light is on).
Jet airways -- wonderful ! Excellent food ! Superb airhostesses ! Good leg space and quite comfortable flight
Indian airlines - Oh man ! what a journey between singapore to chennai. We started late by 3 hours as they took one flight off (cost cutting) and bundled all of those pax with us. And we had to land on exactly 1 wheel (i meant with 1 tyre remaining). Nose wheel had tyres blown out and the back wheel had one blowout. But hats off to the pilot who took us safely. No bassinets, but the crew was cooperative and gave us a bassinet that could be placed down in the floor near your leg. I will vote against the machines (IA) but support the crew.
Singapore airlines - Awesome and hats off so far ! Had a tough time getting a bassinet for my baby as there was a code share with indian airlines (of all airlines - oh my god!). The indian airlines folks goofed up by not sending the bassinet request and food (vegetarian) to singapore airlines. Because going back to 2007 bulletin is lot of work for them. Looking at PD of each application and seperating it from the lot. If they just made it U, its easy...send everything back.
They have to do those work anyway. Because all the applications are not I-485 and also some ppl filed I-140 along with I-485. So, they do have to repackage those applications. Let us see,how events develops for couple of more days?.

Please be considerate to your good employer and good attorney of yours. You do not want to burn bridges, when you leave. Give them at least 2-3 weeks notice. That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.

I agree. The PD for Oct' Bulletin will probably somewhere in mid-end of 2003 and i don't think it'll ever go back to Current .... So what happens to all the 2006,2007 applications ???

My lawyer says they will, most probably, send all the applications back. However, at this point they are not sure what will happen to all the applications, if they don't send back. He sais we will wait some time for more updates from USCIS.
I think 2006, 2007 applications will also come back. Since people from 2002 and 2003 are still waiting, applicants from 2006 and 2007 can just lay back and relax for a while now!

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.
I hope you assume this as a new H1B not a transfer or else your post is wrong.

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?
H1 doesnt work as you are interpreting. OP was working for 'A' and had a valid H1. At some point of time, he got a job offer from X and had his H1 transferred to X. Even though his new H1 is approved, his old H1 is still valid. It is valid as long as OP doesnt join X. Since the OP never left A and never joined X, he was always in status. OP -> this should be a simple case. Since you have documentation to prove that you were in status always and since you never joined X , you dont have paystubs and that should be perfectly fine as long as you never left A.

If you file today it will be past october when you have to choose between EB2 and EB3 (I485 stage for EB2) till that time you have both the process going on EB2 and EB3.
If you start EB2 process in October it will take 6 to 9 months to clear labor and I 140..
I wouldn't make that decision until Oct of 2008.
My personal opinion and analysis tell me that EB2 will soon get retrogressed from what it is today and the picture will not be that rosy in a couple of months.
I would wait until Oct 2008 and see what kind of visa numbers are available at that time for EB2 and EB3 and them make any decision on switching.
Again..just my opinion.

I am not sure but one thing we can see a lot of anti immigration conservatives are not doing too good at house.. so what does this mean.. immigration is an issue by the conservative talk shows...Lou Dobbs.. and people like them and not the gen US public ???
When President Bush delivered his CIR speech, Lou Dobbs criticized CIR as amnesty and he went on suggesting "No bill is better than a bad bill" to Congressman Sensenbrenner et. al.
Sensenbrenner took this advice verbatim and finally rejected CIR instead of conferencing on modifying it.
I think Congress got the blame later and was termed "Do-Nothing Congress" mainly for this.
It is a bitter lesson for politicians not listening to Senate or President but to Lou.

I called an hour ago. The lady said the phones are ringing like crazy for these bills. She was nice to take down the bill numbers, my name, and phone number. I asked her the tipping point when these things get noticed and if we are any close to the number of phone calls. The lady said, call volume is good and it will only help if your community makes more calls.

Fragomen has been great for me
First of all, they are arrogant and they dont understand the needs of the Client/Candidate. Most of the BIG FIRMS use Fragomen. LSI LOGIC, IBM (to name a few) used but eventually LSI LOGIC stopped services with FRAGOMEN.
Because of FRAGOMEN, I dont have EAD inspite of Earlier PD MAR 2005.
1. My Job requires BS + 5 yrs. They had to file in Eb2 but in March 2005, they told me lets file an EB3(since my 5th year was ending in couple of months) and once they are familiar they can file EB2.
2. When i asked them after an year to file in EB2, they told me that i cannot do because i am on 7th year extension. (all most all companies have done that).
3. After that in OCTOBER 2006, i asked to convert my eb3 from NON-RIR to RIR, they took almost 5 months and finally filed on the last day for RIR conversion and by that time BEC stopped processing RIR and started all NON-RIR cases and my labor was not cleared before AUG 17.
4. After that labor was cleared, they took 2 months to file my I-140. They received my papers and i had to literally bang at them to get my I-140 filed.
After all these, they give ask me to give a feedback. i screwed them up and informed my CEO and CFO about the Attitude of Fragomen.

“We have benefited greatly from the many foreign-born scientists, engineers, health care professionals, and teachers that help keep America moving forward,” said Shadegg, a member of the House Energy and Commerce Committee. “To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”
H.R. 5744, The Securing Knowledge, Innovation, and Leadership (SKIL) Act, addresses this growing problem by increasing the allotment of H-1B visas, returning to the prior, higher level of 115,000, with potential for future increases. The bill would also allow foreign nationals who graduate from U.S. universities to stay in America and contribute to our economy by joining the American workforce.
“Unfortunately, we are not graduating the number of Americans with advanced degrees in math and sciences that our high tech and medical industries need to compete. Until we can fix the problem of not having enough highly skilled American graduates, we need to pass the SKIL Bill.”

AILA does not care about people its an organization to take care of lawyer's interest. When you file every year the lawyer can make money every year. So be rest assured they will make some noises but will not bite USCIS.
i am pretty sure, there wont be any fee for next 1 year, for the guys who got 1yr EAD. but, third year u pay again $340 for 2 more years. bottomline,$340 is for 2 years of EAD. otherwise there will another law suit from AILA.
